Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

Decision(s): The Minister agreed to amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002, and to request the Law Draftsman to prepare the necessary draft legislation.

Reason(s) for Decision:

1.     To make permanent six Temporary Orders made by the Minister for Transport and Technical Services under Article 68 of the Road Traffic (Jersey) Law 1956.

2.     To include in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 the currently un-scheduled 1 hour parking bay in Grosvenor Street.

3.     To include in the Road Traffic (St Helier) (Jersey) Order 1996 the requirement for motorists to turn left when exiting the Snow Hill Car Park.

4.     To include in the above Order the requirement for motorists to turn left when exiting the Esplanade Car Park into Castle Street.

5.     To include in the above Order a section of 1 hour pay-card parking on the west side of the bottom section of Mont Cochon.

6.     To include in the above Order a section of prohibition of waiting on both sides of Raleigh Lane.

7.     To remove two, two hour pay-card parking spaces in Oxford Road near to its junction with Byron Lane.

8.     To introduce a yellow box no stopping restriction at the New Street, Union Street, Burrard Street junction.

Action required: Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.

Purpose of the Report  

To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

 

Background  

Between 26 April 2010 and 19 July 2010 six Temporary Orders were made by the Connétable of St Helier, following consultation with the Minister for Transport and Technical Services under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months. These Temporary Orders were required to be implemented without the delay involved in the normal law drafting process, and with the intention of including them in the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 at a later date. 

Additional Requests  

Include in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 the disabled persons parking bay currently marked in Grosvenor Street. 

Include in the Road Traffic (St Helier) (Jersey) Order 1996 the requirements for motorists to turn left when exiting the Snow Hill Car Park and also to turn left when exiting the Esplanade Car Park into Castle Street.  

Due to an omission in a previous Amendment, to include in the above Order a section of 1 hour pay-card parking on the west side of the bottom section of Mont Cochon. 

To include in the above Order a request from the Parish for a prohibition of waiting restriction on both sides of Raleigh Lane. 

To remove two, two hour pay-card parking spaces in Oxford Road due to a new housing development near its junction with Byron Lane 

To introduce a yellow box no stopping restriction at the New Street, Union Street, Burrard Street junction.  
 

Discussion  

Temporary Orders.

                                                                                                                                                                                                                                 The Temporary Orders made under Article 68 of the Road Traffic (Jersey) Law 1956 are as follows:- 

1.  La Ruelle Vaucluse. 26 April 2010. To extend the prohibition of waiting on the south side, and also include the current section of prohibition of waiting which is not scheduled in the Road Traffic (St Helier) (Jersey) Order 1996. The request is considered necessary to improve access, visibility, and safety for residents and road users (Plan No.1) 

2.  Town Mills, Trinity Road. 04 May 2010. To extend the current parking time limit in the 20 minute pay-card section of Town Mills from 9am – 5pm to 9am – 10pm. The request is to improve access by customers to the four shops in the area, and thereby reduce illegal parking along Les Vaux New Road during the evenings. (Photo)  

3. Lewis Street. 21 June 2010. To make the southern section of Lewis Street (currently subject to a one way restriction) two-way, to allow access to the new multi storey car park on the corner of Kensington Place and Lewis Street. (Plan No.2)  

4. St Thomas’ Residents’ Parking Zone. 12 July 2010. Following a review of the first six months of operation of this zone it was decided that due to adverse criticism from the public to return 35 car parking spaces in the Parade area back from residents parking to 1 hour pay-card parking, between 8.00am and 5.00pm, giving free public parking outside those times, and also on a Sunday. (Plan No.3) 

5. St Mark’s Residents’ Parking Zone (RPZ). 12 July 2010. The Organic Shop lost their private customer parking which had an adverse effect on the business. The original 2-hour paycard spaces immediately outside of the shop were often occupied for close to the two hour limit and were rarely available for customers who might only wish to stop for 10 minutes or so. Following consultation with the RPZ permit holders the 2-hour paycard parking was changed to 20 minute paycard parking to serve the customers of the Organic Shop and the adjacent Press Gang business. These spaces remain available for resident permit parking between 5 p.m. and 9 a.m. daily and all day on Saturdays and Sundays. (Plan No.4)  

6. Commercial Street. 19 July 2010. Due to the recent refurbishment of Commercial Street it was decided to introduce several sections of parking of vehicles on roads for loading and unloading, on the south side, of 20 minutes duration, and with times for loading and unloading 5am – 6pm, and to be available for free public parking between these times, and also on a Sunday. (Plan No.5)  

Additional Requests  

The Assistant Manager – Parking Control has been made aware that the 1 hour duration disabled persons parking bay currently marked in the western end of Grosvenor Street is not scheduled in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002. It has now been requested that this facility be formally scheduled in the Order. (Plan No.6) 

For reasons of safety there has been a requirement that all vehicles exiting the Snow Hill Car Park should turn left into Green Street and should not use the Green Street Roundabout. Although for some time there has been a sign at the car park exit to this effect, it has never been included in the Road Traffic (St Helier) (Jersey) Order 1996.  

For reasons of safety, and to limit traffic congestion when exiting the Esplanade Car Park into Castle Street, it is requested that all vehicles be required to turn left when exiting the car park from this exit. Although for some time there has been a sign at the exit to this effect, it has never been included in the Road Traffic (St Helier) (Jersey) Order 1996. As this restriction is currently unenforceable it has been requested that it be formally scheduled in the Order.  

Due to an omission in the last Amendment, to include 43 yards of 1 hour paycard parking at the lower end of Mont Cochon. (Plan No.7) 

The request with regard to introducing a prohibition of waiting restriction in Raleigh Lane is considered necessary due to motorists stopping and obstructing this narrow Parish road. (Plan No.8) 

The request with regard to removing two, two hour paycard parking spaces in Oxford Road near its junction with Byron Lane is made as the access entrance to a new private housing development is obstructed. (Plan No.9)  

The request with regard to introducing a yellow box no stopping restriction at the New Street, Union Street, Burrard Street junction is to assist the free flow of traffic through the junction.  

Parking of vehicles on roads for loading and unloading  

The Assistant Manager – Parking Control has been made aware of a possible anomaly in the St Helier Order whereby he believes that due to an omission in Article 39 of the Order (loading and unloading of vehicles), unlimited loading and unloading outside of the times prescribed in Schedule 10 is allowed. Although it has always been understood that subject to specific cases all unloading bays are free for public parking outside of the times prescribed in Schedule 10, usually 5am – 6pm, it appears that this has never been stipulated in the Order, which therefore technically makes public parking in these bays illegal at all times. This change does not apply to unloading bays in Residents’ Parking Zones where time restrictions already apply at all times. 

The Law Draftsman will be requested to clarify if this is the case, and if so to amend Article 39, to formally allow public parking in unloading bays outside of loading and unloading times.  
 

Recommendation  

The Minister is recommended to approve the above requests.
