Rue de Haut, St. Lawrence: Extension of Parking Restrictions

Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

EXTENSION OF EXISTING PARKING RESTRICTIONS ON RUE DE HAUT ST.

LAWRENCE

Purpose of the Report

To extend an existing prohibition of waiting area on the southern side of Rue de Haut in St. Lawrence.

Background

A request has been received from the Parish of St. Lawrence to extend an existing prohibition of waiting area on Rue de Haut by the northern entrance to Millbrook Manor.

Currently there is a prohibition of waiting line in place but this does not allow for larger vehicles to gain access and the Honorary Police are having to place no waiting signage regularly. The premises are regularly accessed by large vehicles. The extension of the existing prohibition of waiting area by six yards in an easterly direction will remove the need for the Honorary Police to place no waiting signs each time large vehicles are expected.

The temporary changes can be introduced under Article 68 of the Road Traffic (Jersey) Law 1956 by the placing of appropriate signage and publication in the Jersey Gazette. The Road Traffic (St Lawrence) (Jersey) Order 1990 is created under Articles 63, 64 and 84 of the Road Traffic (Jersey) Law 1956.

The Road Traffic (St Lawrence) (Jersey) Order 1990 is administered by Infrastructure, Housing and Environment.

Discussion

The extension of the prohibition of waiting area on Rue de Haut in St. Lawrence requires to be scheduled in the Road Traffic (St Lawrence) (Jersey) Order 1990 and this can be effected using Article 68 of the Road Traffic (Jersey) Law 1956 pending formal scheduling on the next Amendment to the Road Traffic (St Lawrence) (Jersey) Order 1990. Policing of the area will be the responsibility of the Honorary Police of the Parish of St Lawrence.

Recommendations

The Minister is recommended to approve the extension of the prohibition of waiting area by the northern entrance to Millbrook Manor on Rue de Haut in St Lawrence and to instruct Officers to produce the necessary signage, to advise the public using local media and to place the statutory Gazette inserts.

Reason(s) for Decision

Extending the current prohibition of waiting area outside the northern entrance to Millbrook Manor will enable larger vehicles to gain access and will not require the Honorary Police to place no waiting signs each time this is required.
