REMOVAL OF FREE PARKING IN PIER ROAD CAR PARK AND LAY-BYS 1-5 ON
VICTORIA AVENUE ON 27, 28 AND 29 AUGUST 2013
Purpose of the Report
To remove the previously agreed period of free parking approved to assist members of the public who would have been affected by the proposed bus drivers’ strike scheduled for 22, 23, 27, 28 and 29 August 2013, which was cancelled late on the day prior to the strike commencing.
Background
The Minister for Transport and Technical Services had previously approved on 19 August 2013 the provision of free parking in Pier Road Car Park and in Lay-bys 1-5 on Victoria Avenue for 22, 23, 27, 28 and 29 August 2013 to assist members of the public who would have been affected by the planned bus drivers’ strike scheduled for those dates so they would not have suffered any additional penalty for having to use alternative methods of transport during this period. Ministerial Decision MD-T-2013-0078 approved the original provision of the free parking above.
Late on the afternoon of 21 August 2013, the strike was cancelled and a normal bus service continues to run. As a result of this, the need to make the originally approved provision of free parking no longer exists and so the provision should be removed.
Due to the requirement for notice in the JEP Gazette two days in the period of seven days prior to the change taking effect, only the free parking on 27, 28 and 29 August 2013 can be withdrawn.
The temporary changes can be introduced under Article 68 of the Road Traffic (Jersey) Law 1956 by the removal of the previously placed signage. The Road Traffic (Public Parking Places) (Jersey) Order 2006 is created under Article 59 of the Road Traffic (Jersey) Law 1956.
The Road Traffic (Public Parking Places) (Jersey) Order 2006 is administered by the Transport and Technical Services Department.
Discussion
The need for provision of free parking in the specified car parks that was intended to ease any pressure that may have resulted due to the increased volume of traffic during the strike period no longer exists due to the strike being cancelled.
Recommendations
The Minister is recommended to approve the removal of the previously approved free parking in Pier Road Car Park and Lay-bys 1-5 on Victoria Avenue during the proposed bus drivers’ strike and to instruct Officers to place the statutory Gazette inserts.
Reason(s) for Decision
The provision of free parking in the specified car parks that was intended to ease any pressure that may have resulted due to the increased volume of traffic during the strike period is no longer required as the strike has been cancelled.
