De Quetteville Court, St. Helier: Refurbishment: Approval of Scheme

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  • Approved the scheme as set out in permit number P/2013/1136 dated 12th November 2013 and drawings numbered 4694/4, 4694/43, 4694/48 and 4694/5.

 

  • Requested that the Minister for Treasury and Resources accept his recommendations in accordance with States Standing Order 168 (1) (d) & (2).

REPORT TO THE HOUSING MINISTER

TO APPROVE THE SCHEME TO REFURBISH

DE QUETTEVILLE COURT, ANN STREET, ST HELIER.

 

Background

 

The Minister will recall that on the 3rd April 2013, (MD-H-2013-0021 refers), he;

 

  1. Endorsed the Department’s Senior Management Team view that Scheme 2 be developed further by the Design Team; and

 

  1. That the Design team be instructed to submit drawings for combined Planning and Bye-Law application for the scheme; and 

 

  1. That the professional and planning fees, as outlined in the written report, be transferred from the Department’s rolling vote HYR000 to a specific Business Unit to be established for the project.

The Design team, lead by Morris Architects, submitted a planning application and planning approval has now been granted to ‘Refurbish high-rise block to include; Cladding, rain screens, new windows, doors, roof coverings, entrance lobbies and other alterations’, permit number P/2013/1136 dated 12th November 2013 refers.  A copy of the permit and drawings numbered 4694/4, 4694/43, 4694/48 and 4694/51 are attached at annex b.

 

Recommendation

 

That the Minister:

 

  • Approve the scheme as set out in permit number P/2013/1136 dated 12th November 2013 and drawings numbered 4694/4, 4694/43, 4694/48 and 4694/5.

 

  • Request that the Minister for Treasury & Resources accept his recommendations in accordance with States Standing Order 168 (1) (d) & (2).
