Seymour Inn - Car Park, La Grande Route des Sablons, Grouville - Gift to the Public by La Rocque Developments Limited.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

1. The Minister approved, as recommended by Property Holdings, that the Public on behalf of the Environment Department, accept by way of gift, a certain piece of land (formerly depending from the property known as “La Rocque House”) from La Rocque Developments Limited.

Reason(s) for Decision: 

1.  Under Standing Order 168 (1) (a) and 168 (3) the Minister hereby notified the States that he had accepted the recommendation of Property Holdings to agree to the above land transaction. 

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Resource Implications: 

Other than those detailed in the report there are no further financial or manpower Implications.

Action required: 

1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded. 

2.  The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Minister, Treasurer, Deputy Treasurer, the Minister for Planning and Environment and the Director of Environment.

Property Transaction for Ministerial Decision –

Minister for Treasury and Resources  
 

Seymour Inn Car Park, La Grande Route des Sablons, Grouville – Gift to the Public by La Rocque Developments Limited  
 

Purpose  

To seek approval from the Minister for Treasury and Resources to allow the Public to accept by way of gift a certain piece of land (formerly depending from the property known as “La Rocque House”) from La Rocque Developments Limited. 

Background  

The Donor “La Rocque Developments Limited” own an area of land opposite the Seymour Inn currently used as a car park.  It is intended that the land in question be gifted in perpetuity, to the Public for the benefit of the inhabitants of the Island of Jersey. 

Current Situation  

Terms and conditions have been agreed between La Rocque Developments and the Public for a certain piece of land (formerly depending from the property known as “La Rocque House”) to be gifted to the Public on the following basis – 

  • The property will be held in perpetuity by the Public for the benefit of the inhabitants of the Island of Jersey.
  • That no building or construction whatsoever may be built, constructed or established on under or over the property except for a single storey interpretation centre with a maximum height, gross external area and design agreed with the Donor and as set out in the final contract.
  • The Public shall mark the gift of the property by placing a permanent marker, at its cost, identifying the gift having been made by Mr Thomas Hays Scott. Once established the Public shall maintain in perpetuity, the memorial, in good order and condition.
  • The Public will pay the Donor’s legal costs associated with the gift.

 

Prior to the construction of an Interpretation Centre the Environment Department will have secured capital funding or other means of constructing the Centre and will also have identified funding for all associated running costs including repair and maintenance.  The repair and maintenance budget shall then be transferred to Jersey Property Holdings (JPH). 
 
 
 
 
 
 

Conclusion 

Acceptance of this area of land will allow the Public to ensure that the property will be held in perpetuity for the benefit of the inhabitants of the Island of Jersey. 

Recommendation 

JPH recommend that the Public accepts this area of land on behalf of the Public with the operational control resting with the Environment Department who will in turn secure funding for the repair and maintenance prior to any building being constructed on the site and these funds to be transferred to JPH budget.
