La Route de la Liberation: Introduction of a new unloading bay

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

INFRASTRUCTURE, HOUSING AND ENVIRONMENT

 

INTRODUCTION OF NEW UNLOADING BAY BY FINANCE CENTRE

 

 

Purpose of the Report

 

To introduce a new unloading bay on the southern side of the Jersey Finance Centre on the east bound slip road off La Route de la Liberation.

 

 

Background

 

With the creation of the Jersey Finance Centre there is a growing need for unloading facilities to enable deliveries to take place to the buildings located there.  A new unloading bay has been created on the eastbound slip road of La Route de la Liberation which requires restrictions to be applied so policing of the use of this can take place.

 

The restrictions to be applied are a 20 minute maximum stay between 5am and 6pm Monday to Saturday and a requirement for a business name and address and arrival time to be displayed.

 

The temporary changes can be introduced under Article 68 of the Road Traffic (Jersey) Law 1956 by the placing of appropriate signage and publication in the Jersey Gazette. The Road Traffic (St Helier) (Jersey) Order 1996 is created under Articles 63, 64 and 84 of the Road Traffic (Jersey) Law 1956.

 

The Road Traffic (St Helier) (Jersey) Order 1996 is administered by Infrastructure, Housing and Environment.

 

 

Discussion

 

The newly created unloading bay on the eastbound slip road off La Route de la Liberation requires to be scheduled in the Road Traffic (St Helier) (Jersey) Order 1996 and this can be effected using Article 68 of the Road Traffic (Jersey) Law 1956 pending formal scheduling on the next Amendment to the Road Traffic (St Helier) (Jersey) Order 2006.

 

 

Recommendations

 

The Minister is recommended to approve the restrictions on the unloading bay on the eastbound slip road off La Route de la Liberation and to instruct Officers to produce the necessary signage, to advise the public using local media and to place the statutory Gazette inserts.

To add appropriate restrictions to a new unloading bay on the eastbound slip road off La Route de La Liberation which will enable policing of this.
