Regulation of Care (Standards and Requirements) (Amendment) (Jersey) Regulations 202-: Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved amendments to the Regulation of Care (Standards and Requirements) (Jersey) Regulations 2018 (jerseylaw.je) and requested that they be lodged 'au Greffe'.

Reason for Decision(s):

Following the States adoption of P.28/2022, a minor consequential change was required to P.46/2022 prior to its debate. This amendment would, if adopted, amend the expiry date of the Covid-19 related provisions under the Regulation of Care (Standards and Requirements) (Jersey) Regulations 2018 (jerseylaw.je) (the “2018 Regulations”) to 30th September 2022. The amendment was required to update the draft Regulation of Care (Regulated Activities) (Amendment of Law) (Jersey) Regulations 202- (the “draft Regulations”) following the States decision to adopt Regulation 4 of the Covid-19 (Amendments – Extensions to September 2022) (Jersey) Regulations 2022 (P.28/2022) on 31st March 2022. The amendment ensured that the decision of the States to approve P.28/2022 was unaffected by the adoption of the draft Regulations. The draft Regulations were concerned with enacting independent regulation and inspection across social work and mental health services provided to children and young people in Jersey. The draft Regulations do not seek to amend any Covid-19 related provisions under the 2018 Regulations. As a result, and so as not to prejudge the outcome of the States debate on P.28/2022, the draft Regulations provided that all Covid-19 related Regulations would expire on 30th April 2022. As the States had voted to adopt P.28/2022, it was necessary to bring forward this amendment so that provisions in the draft Regulations which were designed to manage the Covid-19 pandemic would expire on 30th September 2022.

Resource Implications: There are no new financial and/or manpower implications.

 

Action Required: Officers to request the Greffier of the States to arrange for the item(s) to be lodged 'au Greffe'.
