Sea Fisheries (Miscellaneous Provisions) (Amendment No. 6) (Jersey) Regulations 201-: Approval of draft to UK Secretary of State

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Approval of draft legislation for forwarding to the UK Secretary of State

Decision(s): The Minister approved that the draft Sea Fisheries (Miscellaneous Provisions)(Amendment No. 6)(Jersey) Regulations 201- be transmitted to the UK Ministry of Justice for approval by the Secretary of State.

Reason(s) for Decision: On 21 November 2008, Senator P Ozouf (then Minister for Economic Development) approved that drafting of the regulations commence (MD-E-2008-0219).

The regulations have now been drafted and prior to their being lodged for approval by the States Assembly, it is necessary for them to be approved by the UK Secretary of State.

Resource Implications: There are no financial or manpower implications.

Action required: Once the draft legislation is approved by the Minister, the regulations are to be forwarded officially for Secretary of State approval by the Crown Officers.

ECONOMIC DEVELOPMENT

 

Draft Sea Fisheries (Miscellaneous Provisions)(Amendment No. 6)(Jersey) Regulations 201-.

 

 

Purpose of the Report

To obtain UK Secretary of State approval for the draft Sea Fisheries (Miscellaneous Provisions) (Amendment No. 6) (Jersey) Regulations 201-.


Background

Each year in the early autumn when the spider crabs change shell, there is a ban on the catching of newly moulted spider crabs. French and Jersey fishermen have been concerned that during this closed season nets could be used or left in the sea in areas where they have a detrimental effect on the newly moulted spider crabs.

 

In September 2008, French and Jersey fishermen agreed at a meeting of the Joint Advisory Committee (established under the terms of the Agreement concerning fishing in the Bay of Granville) that no nets of any sort should be set for the duration of the closed season in an area to the south of Jersey.  The Joint Management Committee (also established under the terms of that agreement) endorsed this recommendation and the (then) Fisheries and Marine Resources Panel also approved the recommendation on 5 November 2008.

 

On 21 November 2008, the Minister approved that law drafting to prohibit the setting of such nets should commence.


Details
Once law drafting commenced, it became apparent that an amendment to the Sea Fisheries (Jersey) Law 1994 would be required before suitable regulations could be drafted.  That amendment has now been enacted and the draft Sea Fisheries (Miscellaneous Provisions)(Amendment No. 6)(Jersey) Regulations 201- have been prepared in accordance with the drafting instructions.

 

The draft regulations do not themselves close the area to netting, but enable the Minister to close an area by Order.  The draft has already received in principle approval from the UK Department for Environment, Food and Rural Affairs.

 

 

Recommendation

The Minister is requested to approve the draft Sea Fisheries (Miscellaneous Provisions)(Amendment No. 6)(Jersey) Regulations 201- and authorise their transmission to the UK for Secretary of State approval.
