A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

RETROSPECTIVE: Display banner to roof.

Decision(s): 

The Minister for Planning and Environment requested that he be consulted with regard to this application.   At a consultation meeting on 30th July 2010  the Minister decided to refuse the retrospective banner and serve an enforcement notice, giving the applicant 28 days to remove it.

Reason(s) for Decision: 

The principle of the banner is considered overly large and inappropriately located, resulting in a scheme which causes visual harm to the character of the surrounding area and roofscape, and is therefore considered contrary to Policy Advice Note No. 7 July, 1994 and Policy G18 of the Jersey Island Plan, 2002. 

An enforcement notice is required to be issued and served with the refusal notice, requiring the removal of the banner within 28 days of the date of the decision.

National Trust Objection  - the banner is too high up and overly large, dominating the roof line of the Grand Hotel and the area generally. Hope that it will be removed from the car park. 20/5/10

Officer Summary

The proposed banner sign, is a commercial banner, proposed to be temporary for the rental of parking spaces within the new car park known as Kensington Gate, behind the Grand Hotel. It is currently in place, photos have been taken of the banner in situ.  

Planning Advice Note No. 7, July 1994, presumes against any advert located at or above first floor level or that includes letters or symbols greater than 0.3 m in height. This Advice Note also states, ‘New signs should be sympathetic to the individual building as well as the character of the area. Wherever possible signs should be incorporated into existing the shop front or building without harming its design or appearance. A high standard of design, materials and construction will be expected at all times.’ 

It is considered that the proposed banner sign on the roof of the car park is inappropriately located, which is considered to cause harm to the roof scape of the Grand Hotel towards the town centre. It is also considered overly large and contrary to Planning Advice Note No. 7. It is therefore considered that the principle of the banner is not in accordance with Policy G18 of the Jersey Island Plan, 2002. It is recommended therefore that the banner is not given permission, temporary or otherwise and an enforcement notice is served on the applicant for its removal.
