A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION: Decision: The Chief Minister approved the following nomination to the Jersey Teachers’ Superannuation Fund Management Board following a vacancy on the Board. Mr Mark Bardsley has been nominated to act as representative for the Employees’ side for the remainder of the term of office for 2014 and 2015. Mr Mark Bardsley - Lecturer at Highlands College, nominated and fully supported for this role by the NASUWT. Mr Bardsley is qualified in Mechanical Engineering and has been teaching the mechanics of Mathematics to school leavers through to adult education at Highlands College since September 2014. Qualifications BEng(Hons) Mechanical Engineering Lecturer in Mathematics Highland College Reason for Decision: Paragraph 3 of the Teachers’ Superannuation Fund (Administration) (Jersey) Order 2007 gives the Chief Minister, the Treasury and Resources Minister and the Education, Sport and Culture Minister the power to nominate two representatives from each Ministry to act for the Employers’ side. The Chief Minister also approves those nominees nominated by the representative bodies of the Employees’ side. The Chief Minister is recommended to approve the above person who is considered to have the relevant experience to act in such a capacity as outlined in the attached report. It is the Chief Minister who is responsible for making Orders under the Law and for the administration of the Scheme. The current term of office for the Management Board ceases on 31st December 2015.
RESOURCE IMPLICATIONS: There are no financial or resource implications arising from this decision.
ACTION REQUIRED: Project Manager – Pensions to advise the Management Board and Mr Bardsley of the Chief Minister’s decision.
