Amendments to the Road Traffic (St. Lawrence) (Jersey) Order 1990 - Traffic Management.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St Lawrence) (Jersey) Order 1990

Decision(s): Following public consultation, the Minister made the Road Traffic (St Lawrence) (Amendment No. 21) (Jersey) Order 2008 to become effective seven days after it is made, the purpose of which is to improve traffic management in the Parish by:- 

  1. Removing the current 12 hours in any continuous period of 24 hours parking on La Route de St Aubin, between St Matthews Church and “Magnolia Gardens”;
  2. Reducing the current parking spaces on La Route de St Aubin near “Walkers Newsagent” and introduce 20 minute paycard parking;
  3. Replace the current 20 minute paycard parking on Le Chemin des Moulins with one hour paycard parking.

Reason(s) for Decision:  At the request of the Connétable to amend the Road Traffic (St Lawrence) (Jersey) Order 1990.

Resource Implications: Law drafting time, Transport and Technical Services Department time.

TRANSPORT AND TECHNICAL SERVICES

 

 ROAD TRAFFIC (SAINT LAWRENCE) (JERSEY) ORDER 1990

 

 

Purpose of the Report

 

To amend the Road Traffic (St Lawrence) (Jersey) Order 1990.

 

Background

 

On 11 June 2008 the Minister for Transport and Technical Services approved requests by the Connétable of St Lawrence to:-

 

  1. Reduce the number of  12 hours in any continuous period of 24 hours parking spaces on the section of  La Route de St Aubin, between St Matthews Church and “Magnolia Gardens”.

 

  1. Reduce the number of  parking spaces near “Walkers Newsagents”, on La Route de St Aubin, and introduce a 20 minute paycard parking restriction.

 

  1. Replace the section of 20 minute paycard parking on the west side of Le Chemin des Moulins with one hour pay-card parking.

 

Discussion

 

Following the posting of public consultation notices, complaints were received from residents of Magnolia Gardens regarding the danger of allowing the reduced number of vehicles to  park on La Route de St Aubin, between St Matthews Church and “Magnolia Gardens”. After further consultation with the Connétable, and the Minister, it was decided to remove all 12 hours in any continuous period of 24 hours parking on this section of La Route de St Aubin.

 

The Minister is requested to approve the attached Road Traffic (St Lawrence) (Amendment No.21) (Jersey) Order 2008, with regard to the above items, to be included in the Road Traffic (St Lawrence) (Jersey) Order 1990.

  

Recommendation

 

The Minister is recommended to approve the Amendment to be effective from seven days after the Order is made.
