A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister for Planning and Environment determined that;

  1. A notice be served indicating his intent that Rose Cottage should be added to the Register.

Reason(s) for Decision:

 Registration of Rose Cottage as a BLI is in accordance with the published policy guidance as follows:

  The building retains its historic form and detail ,and so makes a significant and positive contribution to the architectural and historical character and appearance of Jersey;

  The building is significant for its architectural design,craftsmanship, composition and use of materials;

  The building illustrates aspects of jersey’s social,economic and cultural history; and satisfies the criteria which states that “ in Jersey ,any building which survives in recognisable form from before the middle of the 19th century will normally be of registerable quality for its historic interest”

   The building is of scenic value.

This report has been prepared by Jersey Heritage as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the architectural, historical and archaeological significance of buildings and sites.

 

The assessment and recommendation are made in accordance with the principles of selection for registration as set out in the interim policies for the conservation of historic buildings (1998). The report includes the views and advice offered by the Ministerial Registration and Listing Advisory Group.

 

The Planning and Environment Department requested on 11 April 2008 that Jersey Heritage assess the architectural, historical and other interests of Rose Cottage.

Architectural interest

 

Rose Cottage is a single-storey, 3-bay property which substantially retains its external historic form and features, and has a distinctive architectural character. It is rendered with imitation ashlar and has a pitched slate roof with notable oversailing eaves (with uPVC soffits, guttering and modern rooflights) and pair of rendered chimney stacks with a decorative cornice band. There is a timber panelled front door with plain overlight, 16-pane timber sash windows without horns to the front elevation; and the same to rear with smaller stair windows at the centre. There are 12-pane sash windows at attic level on the east gable; and replacement windows of a different pattern on the west gable.

 

Scenic interest / group value

 

The cottage makes a positive scenic contribution to the area although the surrounding gardens have been subject to modern landscaping and provision for car parking.

 

Advice offered by MRLAG (and others if stated)

 

MRLAG discussed the building at its meeting on 9 June 2008. Members unanimously agreed with the JH recommendation to add the property to the Register as a BLI.

 

Jersey Heritage recommendation

 

Rose Cottage should be added to the historic buildings register as a Building of Local Interest.

 

Justification relating to criteria

 

Registration of Rose Cottage as a BLI is in accordance with the published policy guidance as follows:
