Request for an Alfresco Area at the 'S' Bar, La Motte Street, St. Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister agreed to the request for an alfresco area, 1.8m width by 6.5m length, for a trial period of 1 year initially, and thereafter assuming that its use is safe and convenient.

Reason(s) for Decision:  The proposal will support the urban renewal works in the area and contribute to the vibrancy and economy of the town centre.

Resource Implications:  The alfresco area will be provided at the expense of the applicant.  Retractable bollards on the unloading bay will be provided as part of the La Motte Street urban renewal works funded jointly by the States and the Parish.

Action required:  Inform the applicant and the Connétable of St Helier, who may issue the applicant with a licence.

TRANSPORT AND TECHNICAL SERVICES  

ALFRESCO PROPOSAL AT THE ‘S’ BAR, LA MOTTE STREET  
 
 

Purpose of the Report  

An alfresco area is proposed at the ‘S’ Bar in La Motte Street.  The Connétable of each Parish administers requests for Alfresco Licences under the Customary Law (Chose Publiques) (Jersey) Law 1993, but requires the permission of the Minister for Transport and Technical Services where the alfresco area is on a main road, as in this case. 
 

Background  

A previous request for an alfresco area at the ‘S’ Bar had been declined by the previous Minister on the grounds that a valuable unloading bay would be lost and the alfresco would result in the public consuming alcohol on the roadside immediately beyond a sharp bend for traffic entering La Motte Street from Colomberie.  At that time an urban renewal scheme was being considered for La Motte Street and it was concluded that the alfresco proposal could be reconsidered when the details of that scheme were known. 
 

Discussion  

The urban renewal scheme has been designed and a consultation exercise has been carried out by the Parish of St Helier. No objections to the alfresco area being created or the loss of the unloading bay, after 11am each day, were received.  The applicant would provide a rail to ensure that users of the alfresco area do not encroach beyond the approved area. 

The urban renewal scheme proposes to remove parking, widen footways and create a raised road surface without footpath kerbs in order to create improved pedestrian space, slow vehicle speeds and encourage shoppers to continue from Queen Street into La Motte Street.  The removal of the unloading bay and creation of an alfresco each day after 11am would be consistent with the aims of the scheme.  The alfresco area of 1.8 metres width and 6.5m length would be alongside the ‘S’ Bar building with the footpath displaced onto the unloading area as shown on the attached plan. 
 

Conclusion  

The alfresco proposal would be consistent with the aims of improving the streetscape of La Motte Street and should be supported.  
 
 
 

Recommendation  

The Minister is recommended to approve the proposed alfresco area, 1.8m width by 6.5m length, initially for a trial period of one year, and thereafter assuming that its use is safe and convenient.

The proposal will support the urban renewal works in the area and contribute to the vibrancy and economy of the town centre.
