Police Negotiating Board: Appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

APPOINTMENT OF OFFICIAL SIDE MEMBERS OF THE POLICE NEGOTIATING BOARD

 

  1. Background

 

The Minister will be aware that Schedule 2, Article 11 of the Police Force (Jersey) Law, 1974, sets out the constitution of the Police Negotiating Board (referred to as the Board).  The functions of the Board are to negotiate and make recommendations to the States Employment Board (SEB) on:

(a)   The pay, terms and conditions of service of all members of the force represented by the Association (Police); and

(b)   Any other related matters that the SEB and Association agree should be referred to the Board for a recommendation.

 

The functions of the Board are limited to making non-binding recommendations on matters referred to in (a) and (b) above for consideration by the SEB.

 

  1. Current situation

 

The Board consists of an Official Side and a Staff Side.  The Official Side should consist of 4 Members, two of whom shall be appointed by the Minister for Home Affairs, and two of whom shall be appointed by the States Employment Board.

 

A Member of the Official Side shall hold office for three years from the triennial election by the States of Jersey of a new Council of Ministers.   As there is now a newly appointed Council of Ministers and a newly appointed States Employment Board it is an appropriate time to confirm the appointments on the Official Side.

 

  1. Proposal for the future.

 

The Minister is required to appoint two members for the Official Side.  The Chief and Deputy Chief of the States of Jersey Police are not eligible for membership of the Board but may attend any meeting and provide independent advice and information at the request of either side.  It is therefore necessary to appoint two non-uniform employees to fulfil these roles.

 

The suggested appointees are the Chief Officer, and Finance Director for Home Affairs.  Neither work directly for the States of Jersey Police but have a strong link with the Force, have significant senior management experience and are fully capable or representing the Minister in negotiations.  Both Officers are agreeable to the appointments.

 

 

 

 

 

  1. Ministerial Recommendation

 

The Minister is recommended to:

 

(a)   approve the appointment of the Chief Officer and the Finance Director for Home Affairs as members of the Police Negotiating Board

(b)   advise the States Employment Board of this decision.
