2009/10 Winter Bus Services.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  With reference to MD-TTS-2009-0071, the Minister approved: 

  1. The proposals for changes to the 2009/10 winter bus services as advertised and detailed in Appendix A of the attached report; and
  2. The minor timing changes on Routes 5 and 9 as detailed in the attached report.

Reason(s) for Decision:  There were no adverse comments received following the public notice prescribed in accordance with Article 24 of the Motor Traffic (Jersey) Law 1935 and the changes being proposed enhance the winter network, remove some anomalies or duplications and eliminate some inconsistencies between the summer and winter timetables.

Resource Implications: 

The total cost of these proposals is £14,500 but this will be offset by additional fare revenue. The net cost can be funded by increased revenue elsewhere on the network.

TRANSPORT & TECHNICAL SERVICES  

CONFIRMATION OF 2009/10 WINTER BUS SERVICES  
 

Purpose of the Report  

To seek the approval of the Minister to proposals for 2009/10 winter bus services further to the request for comments from members of the public on the proposals. 
 

Comments  

  1. On 10 July 2009, the Minister provisionally approved changes to the winter 2009/10 bus timetable and determined that public notice of his provisional decision should be given in accordance with Article 24 of the Motor Traffic (Jersey) Law 1935. Ministerial decision MD-T-2009-0071 details the proposals and the reasons for recommending the changes and a summary of them is attached at Appendix A for information.

 

  1. The proposals were advertised in the Gazette section of the Jersey Evening Post on 16 July 2009 with a deadline for comments to be received by 31 July 2009.

 

  1. Only one response has been received in response to the request for comments but this related to vehicle usage on the network and made no adverse comments on the proposals.

 

  1. Connex have subsequently requested two other minor changes which will bring the summer and winter timetables into line. These are:

 

  1. Route 5 08.35 departure from Liberation Station to change to 08.40
  2. Route 9 08.35 departure from Liberation Station to change to 08.45

 

As these changes are of 5 and 10 minutes only, consultation is not required but the Connex 21 day advertisement in the JEP will draw the public’s attention to the amendment. 
 

Recommendation 

With reference to MD-TTS-2009-0071, the Minister is recommended to approve:  

  1. The proposals for changes to the 2009/10 winter bus services as advertised and detailed in Appendix A to this report; and

 

  1. The minor timing changes on Routes 5 and 9 as detailed above.
