Le Marais Phase 2 - Virement of Funds

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The transfer of funding from the remaining income generated by the sales of properties at Phase 1 Le Marais and a balancing sum from the Housing Department’s rolling vote in order to form the Budget for Phase 2 Le Marais. Together with a non essential variation to all the resurfacing of the loop road as described in the accompanying report.

To comply with Financial Direction on the virement of project funding, and on Non essential variations Financial Direction 5.6 Para 5.8.19.

Le Marais Phase 2 - Virement of Funds

REPORT TO THE HOUSING MINISTER

 

LE MARAIS PHASE 2

 

The Minister will recall that Le Marais Low Rise Phase II & III (now referred to as Phase 2) involved the demolition of blocks A, B, C & D (containing 12no. bedsits, 16no. one bedroom flats and 20no. two bedroom flats) and the construction of 24no. three bedroom houses and 4 no. four bedroom houses, and 16no. one bedroom flats, 2no. one bedroom disabled adapted flats and 1no. two bedroom disabled adapted flat.  Seven of the houses are already complete, 5 have been let to States tenants and the remaining two houses are to be sold in accordance with the provisions of the Property Plan.  The remainder of the homes are due for completion early in 2009.

 

There are a number of administrative issues which require the Ministers approval in order to bring this project to completion. These issues are:

 

  The Virement of Funds

 

Funds need to be transferred from the income generated by the sale of properties at Phase 1 Le Marais in 2006 together with a balancing sum from the Housing Department’s Rolling vote in order to form the Budget for Phase 2 Le Marais.

  Non essential Variation in compliance with Financial Direction 5.6 Para 5.8.19

 

The road surface at Le Marais has suffered during the extensive building and refurbishment program over the last 9 years.  Whilst some road calming measures, are included in the present project, there is no existing provision for repairs to the condition of the road surface.  Areas of deterioration are quite significant and if left un-repaired will create an unacceptable risk to health & Safety in the long term.  This can only be adequately mitigated by the complete resurfacing of the loop road, during which traffic calming measures will also be installed.  The estimated cost of these works is £95,000 (Less an omission of £13,300.00 in existing contract).

 

Recommendation

 

That the Minister:-

 

  1. Authorise the two virements outlined above

 

  1. Approve the Non Essential Variation detailed above in accordance with Financial Direction 5.6 Para 5.8.19.

 

  1. Authorise the Director of Estate Services to sign the necessary instruction on his behalf and to arrange the virement of the necessary funds to the appropriate account.
