A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Extend existing entrance porch to first floor level to convert attic space into an additional bedroom.  REQUEST FOR RECONSIDERATION of refusal of planning permission.

Decision(s):

At a public meeting on the 18 January 2008 the Minister declared a conflict of interest in that he had been the developer for the house in question and therefore asked that the Assistant Minister make the decision at a further meeting to be held with the applicant and officers.  As there were no representations on this application it was agreed that this meeting would take place outside the public arena. 

The meeting with the Assistant Minister took place in April and it was agreed that there was scope to achieve an extension but not in the submitted form.  The applicant was invited to submit revised plans for discussion with the Officers of the Department.  Revised drawings were subsequently received and deemed to be acceptable by the Assistant Director of Development Control who instructed the Officer to issue a permit on the 25th June.

Permission has been granted having taken into account the relevant policies of the approved Island Plan, together with other relevant policies and all other material considerations, including the consultations and representations received.

Reasons

1. The proposed extension, by virtue of its size both in terms of height and form would appear overbearing from the roadside and by its mass, form and location would be detrimental to the character of the Building of Local Interest group.  The proposed alterations to the roof would be particularly harmful to the character and integrity of the existing building.  The proposed dormers are too large and would be out of character with the existing building and therefore the overall proposals are contrary to Policy G13 of the Island Plan.

Comments on Case

Since the refusal of the application the property has been removed from the Register as a Building of Local Interest.  Notwithstanding this it is still considered that the form of the extension presents an awkward and discordant appearance which is visually harmful. The extension is taller to the eaves than the existing building and includes a flat roof which destroys the balance and proportions of the building which, although is not a registered building, is a good example of polite rural architecture in a prominent location.
