Prison! Me! No Way!!!: Funding 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Additional grant to Prison! Me! No Way!!! in 2012.

Decision(s):  The Minister approved the making of a further grant in the sum of £25,000 to Prison! Me! No Way!!! in 2012.

Reason(s) for Decision:

  • Amendment 15 to the States 2012 Draft Annual Business Plan consolidated the available funding for P!M!NW!!! in 2012 under the BaSS service area within the Home Affairs Department, this amounts to £35,000.
  • Amendment 15 also stated that ‘The Council of Ministers is prepared to commit to top up any shortfall in funding agreed with ‘Prison! Me! No Way!’, up to a total of £60,000, during 2012…….. With the funding consolidated under one department, there will be a clear relationship with ‘Prison! Me! No Way!’ to establish future provision of services and available funding.
  • As the Department had a greater underspend at the end of 2011 than forecast, the Council of Ministers has agreed that the shortfall in funding in 2012 for PMNW can be met from the Department’s carry forward.
  • Amendment 15 anticipated that within the next 6 months, discussions will take place with all partners to review the current provision for PMNW. Under the proposed arrangements the Minister for Home Affairs will have responsibility to negotiate with PMNW and to establish an extended Service Level Agreement (Partnership Agreement) as soon as possible.

Resource Implications: The additional grant will be funded from funds approved for carry forward from 2011.

Actions required:  The Minister to sign the 2012 Partnership Agreement with Prison! Me! No Way!!! and the Home Affairs Department to arrange for payment of the additional grant to Prison! Me! No Way!!!
