Battle of Flowers 2006 Road Closures.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

APPLICATION FROM THE BATTLE OF FLOWERS ASSOCIATION FOR ROAD CLOSURES DURING 2006 EVENT

Purpose of the Report

To obtain ‘Ministerial Decision’ regarding approval of road closures for the purpose of the Battle of Flowers 2006 event.

Background

The Battle of Flowers Association has submitted details of its proposed road closures for the 2006 event. Road closures for the event are enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”. A draft Order has been prepared and circulated to the Connétables of St Helier and St Lawrence for consultation in accordance with the law, a copy is attached to this report.

Discussion

The arrangements for this year’s event will be similar to those of last year in that the arena will be located further west along Victoria Avenue. Laybys 1 and 2 will be utilised for storage and general viewing. Stands will be erected in laybys 3, 4 and the Lower Park. Layby 5 will be used as a viewing area for disabled people. Layby 6 will be used for storage of materials. Layby 7 is a contingency venue for the parking and display of floats, should Millbrook Field (opposite) become unavailable.

The Parking Control Section have approved the closure of laybys in accordance with the draft Order and accepted the potential loss of revenue from parking charges on the basis that laybys 1 and 2 are closed for the minimum possible period (3 and 6 chargeable days respectively).

Victoria Avenue and its approach roads will be closed between 9.30am and 7pm on Thursday 10th August for the main event and again between 6.15pm and midnight on Friday 11th for the “moonlight parade”. This closure will continue until 3am on Saturday 12th August for Victoria Avenue, east of First Tower.

The entry arch will be erected in its normal position at West Park.

This year La Rue de Haut (St Lawrence) is to be closed between 5am and 7pm on Thursday 10th August, and again between 6.15pm and midnight on Friday 11th August, to traffic travelling west from its junction with Le Mont Cambrai. The purpose is to improve the additional flow of traffic travelling eastbound as a result of the closures of Victoria Avenue.

Other details are as per the 2005 Order.

Recommendation

The Minister is requested to approve the Battle of Flowers (Jersey) Order 2006, as prepared.
