Closure of Schools and Day Care Accommodation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Closure of schools and day care accommodation to prevent the spread of Covid-19 from 17/07/2020 to 01/09/2020

Decision(s):  In accordance with COVID-19 (SCHOOLS AND DAY CARE OF CHILDREN) (JERSEY) REGULATIONS 2020, the Minister for Education decided to publish a notice requiring the closure of schools and day care accommodation as detailed in the written report.

Reason(s) for Decision: To prevent the spread of Covid-19 by limiting the children attending schools and day care accommodation to those specified within the written report.

 

Resource Implications: None

 

Action required: The Head of Communications for Children, Young People, Education and Skills (CYPES) to ensure the notice is publicised in accordance with the COVID-19 (SCHOOLS AND DAY CARE OF CHILDREN) (JERSEY) REGULATIONS 2020. The Group Director for Education, CYPES, to ensure home learning provision is continued throughout the period of closure, where required.

Notice of School and day care accommodation closures

 

DRAFT COVID-19 (SCHOOLS AND DAY CARE OF CHILDREN) (JERSEY) REGULATIONS 2020

 

The Minister for Education requires the closure of all Government provided and non-provided schools and registered day care accommodation as specified below:

 

 Period of closure: Friday 17th July 2020 to Tuesday 1st September 2020

 

Specified schools or day care accommodation

Specified persons in respect of whom the school premises are, or day care accommodation is, closed and specified circumstances and exceptions where they are not closed in respect of specified persons.

All Government provided school nurseries, mainstream primary and secondary schools and colleges, special schools and provisions

Open to groups of children in consultation with the Minister’s representative (Group Director for Education) and in accordance with the Government of Jersey’s Safe Exit guidance for the re-opening early years settings and schools.

All private nurseries and pre-schools

Open to groups of children in accordance with the Government of Jersey’s Safe Exit guidance for the re-opening of early years settings.

All non-provided primary and secondary schools

Open to groups of children in consultation with the Minister’s representative (Group Director for Education) and in accordance with the Government of Jersey’s Safe Exit guidance for the re-opening of schools.

All other registered day care accommodation

Childminders are open to all children.

After school clubs can now re-open.

All other registered Childhood settings are able to open, which include holiday clubs, play care providers and activity clubs.

Highlands College

Open to adults taking examinations, small group Professional Centre CPD courses for adults, assessment centre for adults on Social Work Degree.
