Road Traffic (Trinity) (Jersey) Order 1988: Temporary Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister approved a temporary modification of the Road Traffic (Trinity) (Jersey) Order 1988, in accordance with Article 68 of the Road Traffic (Jersey) Law 1956, in order to prohibit waiting on both sides of La Rue du Carrefour for a period not exceeding 12 months to prevent possible obstruction to vehicles accessing the construction site of Les Maisons Cabot.

Reason(s) for Decision: To improve road safety on La Rue du Carrefour.

 

Resource Implications: Jersey Gazette notice - £80. Road marking - £50. Officers’ time - four hours.

 

Action required: The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956 relating to temporary modification.

TEMPORARY AMENDMENT TO PROHIBIT WAITING ON

 LA RUE DU CARREFOUR, TRINITY

 

 

Purpose of the Report

 

To make a temporary amendment to the Road Traffic (Trinity) (Jersey) Order 1988.

 

 

Background

 

The Connétable of Trinity has requested a temporary amendment to the Road Traffic (Trinity) (Jersey) Order 1988, to prohibit waiting on both sides of La Rue du Carrefour. The temporary order to be made under Article 68 of the Road Traffic (Jersey) Law 1956 for a period not exceeding 12 months.

 

 

Discussion

 

The Connétable requests temporary prohibition of waiting on both sides of La Rue du Carrefour during the construction of the second phase of “Les Maisons Cabot”. The Connétable points out that any vehicles parked in La Rue du Carrefour during this period would obstruct commercial and builders vehicles from gaining access to the site, as this road is very narrow.  The prohibition of waiting to be removed on completion of the work at “Les Maisons Cabot”.  

 

 

Recommendation

 

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956 to come into effect within seven days after its insertion into the Jersey Gazette.

To prohibit waiting on both sides of La Rue du Carrefour for a period not exceeding 12 months from the notice insertion date in the Jersey Gazette.
