Jersey Teachers’ Superannuation Fund (JTSF): Management Board: Appointment Recommendation to the Chief Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Recommendation to the Chief Minister to appoint a nominee to the Jersey Teachers’ Superannuation Fund (JTSF) Management Board

 

Report Title: Nominations to the Jersey Teachers Superannuation Funds (JTSF) Management Board

Decision(s):

The Assistant Minister for Education and Lifelong Learning decided to recommend to the Chief Minister, the appointment of Ms. G. Liew to the Management Board of the JTSF.

Reason for Decision(s):

In accordance with Article 3(1)(a)(i) of the Teachers’ Superannuation Fund (Administration) (Jersey) Order 2007 (Administration Orders) the Chief Minister shall appoint to be members of the Management Board 6 Employer representatives of whom –

 

2 shall be persons recommended by the Minister for Treasury and Resources

2 shall be persons recommended by the Minister for Education and Lifelong Learning

and

2 shall be any persons that the Chief Minister thinks fit.

 

and 6 member representatives, who shall have been selected in the manner that the Chief Minister shall agree with associations that appear to the Minister for Education and Lifelong Learning to represent the interests of teachers.

 

Members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. The Chief Minister may at any time remove from office any member of the Management Board appointed by him or her under this article.

 

This appointment follows the final term of office from Mr J. Everett, who has retired.

Resource Implications: There are no financial or staffing implications as a consequence of this decision.

 

Action Required: Assistant Minister for Education and Lifelong Learning, Connétable R. Vibert, to recommend to the Chief Minister the appointment of Ms. G. Liew as an employer representative of the Jersey Teachers Superannuation Fund (JTSF) Management Board, for a period of 3 years.
