The law for property sales and letting businesses
The
Consumer Protection (Unfair Practices) (Jersey) Law 2018 applies to the full spectrum of property sales and letting businesses.
The law covers:
- traditional high street estate agents providing a wide range of services
- businesses providing a limited service such as:
- introducing potential buyers and sellers
- enabling them to exchange contact details
- anyone who supplies services related to letting of privately owned residential property as part of their business
The standards expected to comply with the Law will depend on the circumstances, including the level of service a business provides.
Guidance
Some guides have been produced in the UK to reflect compliance with the Consumer Protection from Unfair Trading Regulations 2008. The Jersey Law is based on this legislation so these guides are intended to help you comply with the requirements under the law in Jersey.

The guidance is principally intended to help you comply with the legislation. It seeks to illustrate how the law may apply in practice.
Ultimately however, only the courts can decide whether or not a commercial practices is unfair within the meaning of the Law.
These guides should therefore not be regarded as a substitute for, or definitive interpretation of the Law and should be read in conjunction with the Law.
