About indefinite leave to remain
If you've lived in the United Kingdom legally for a certain length of time, you may be able to apply to settle here. This is called ‘indefinite leave to remain’.
It allows you to stay in the United Kingdom and Islands permanently without any restrictions from immigration on your stay and employment.

Criteria for indefinite leave to remain
To apply for indefinite leave to remain in Jersey, you must:
- have lived legally in the UK or the Channel Islands for an unbroken period of continuous residence of 5 years with valid leave to remain
- pass the Citizenship test (also known as a 'Life in the UK' test)
- meet the English language requirement
How to apply for indefinite leave to remain
Indefinite leave to remain applications will be accepted no more than 2 weeks before you’re is eligible to apply, and you must be able to demonstrate that all the criteria is met.
To complete and submit this application you'll need:
- current and previous passports of the main applicant
- current and previous passports of any dependents applying for indefinite leave to remain on this application
- birth certificates of any dependent children applying for indefinite leave to remain on this application
- marriage certificate, if applicable
- evidence that the main applicant has funds to maintain and accommodate themselves and dependents without recourse to public funds
- evidence that you have suitable accommodation. This should take the form of a tenancy agreement or the deeds to a property
- evidence you and any adult dependents meet the English language requirements
- evidence you and any adult dependents have passed the Citizenship test
- other information may be required is support of your application depending on the immigration permissions you are applying for. You'll be prompted what to provide on the documentary evidence page of this application
With the exception of the passports, you'll need to upload this information into the application prior to submission.
You'll need a debit or credit card to make payment.
If we require additional documentary evidence in support of the application an Officer will contact you directly using the information you have provided in this application.
Once you've completed the online application form:
- your application and supporting documents will be sent electronically to the Jersey Customs and Immigration Service
- you'll receive a PDF copy of your application that you'll need to print off and submit along with your passports, and those of your dependents
- submit your application in the post to Immigration Casework, Maritime House, La Route Du Port Elizabeth, St Helier JE1 1JD
Note that this building is not open to the public - you'll be notified by phone or email when your documents are ready to collect
Allow 3 weeks for applications to be processed from the date we receive your passports.
You must have all the information available before starting the application as there isn’t an option to save your progress.

Your immigration status while your application is being considered
Your existing immigration status will continue until your application is decided. Even if the decision is made after your permitted stay ends.
You can also continue to work until your case is decided if your existing permission allows you to.

English language requirement
You must meet the English language requirement in one of the following ways:
Possess a qualification or have passed a test at level B1, B2, C1 or C2 in listening and speaking as specified on Prove your English language abilities with a secure English language test (SELT) on GOV.UK
English language testing is offered in Jersey by UK Government approved Secure English Language Test providers, IELTS SELT Consortium (ISC) and Pearson. 2. possess an academic qualification deemed by ECCTIS (UK ENIC) to meet the recognised standard of a Bachelor's of Master's degree of PhD in the United Kingdom and:
- ECCTIS (UK ENIC) has confirmed that the qualification was taught or, as the case may be, researched in English; or
- the qualification was taught or, as the case may be, researched in any of the following English speaking countries (Antigua and Barbuda, Australia, the Bahamas, Barbados, Belize, Dominica, Grenada, Guyana, Jamaica, New Zealand, Republic of Ireland, St Christopher and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago, USA); or
3. you possessed a qualification or had passed a test in English at a level equivalent to Level B1 or above on the Council of Europe's Common European Framework of Reference for Languages: Learning, Teaching, Assessment; or
4. being a national of the following English speaking countries: Antigua and Barbuda, Australia, the Bahamas, Barbados, Belize, Canada, Dominica, Grenada, Guyana, Jamaica, New Zealand, Republic of Ireland, St Christopher and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago, USA

you’re under 18 years old
you’re 65 years old or over
you have a mental health or physical condition that makes it unreasonable to expect you to meet this requirement
