Updated notice
Further to previous notice of proposed changes to the Greville Bathe and AA Rayner funds (July 2021), which were anticipated to be presented at the Royal Court on 9 September 2021, please be advised that these changes will now be presented at the Royal Court on 18 October 2021.
These changes propose empowering the Trustee to appoint/ terminate the appointment of independent income administrators to the Greville Bathe and AA Rayner trusts, and to provide the Trustee with the option to appoint a corporate body as a single income administrator (subject to equivalent criteria as the appointment of individuals as income administrators). There are no changes to the objects concerning award criteria proposed.

Any original donor, family member thereof or other interested person wishing to express views in respect of the proposed Court application, including any objection thereto, should write to that email address by no later than close of business 15 October 2021 or alternatively attend the hearing of the Royal Court at 11am Monday 18 October 2021.

Notice is hereby given of the intention of the Treasurer of the States to apply to the Royal Court on the 9th of September in respect of the trusts listed below. The Court will be asked to make orders to give effect to the following actions. These actions are being taken for the purpose of ensuring the two funds may be better applied in a manner that remains consistent with the original intentions of the settlors, and in a way that allows them to continue to be administered in a coordinated manner.
The Funds
Changes under Article 47A of the Trusts (Jersey) Law 1984
(a) In respect of the trust (1) above, to amend the award restrictions on sub-fund A to ensure that its awards meet the criteria of a charitable trust;
(b) in respect of trusts (1) and (2) above, to better define the role of Income Administrator referred to in the Wills, to more clearly distinguish their areas of responsibility from those directly under the control of the Trustee;
(c) in respect of trusts (1) and (2) above, to enable a charity registered with the Jersey Charity Commissioner, or a fiduciary business regulated by the Jersey Financial Services Commission, that has a quorum of at least four Jersey resident directors, to be appointed as sole independent Income Administrator; and
(d) in respect of trusts (1) and (2) above, to empower the Trustee to appoint the Income Administrator
