Enactments in the gazette to end on 28 September 2021

From 28 September 2021 the Jersey Gazette will cease publishing notices of new enactments.

All enactments are published on the website of the Jersey Legal Information Board (JLIB), where the home page has a regularly updated list headed Latest Laws. On the Laws page of that website readers can use the As Enacted tab to search all enactments made, which can be listed in date order with the newest first. 

Until 28 September 2021 the Gazette notices for enactments were based on the Explanatory Notes produced by the Legislative Drafting Office for each enactment. After that date the Explanatory Notes can still be found on the website of the States Assembly

  • For a Law or Regulations (or other enactment made by the Assembly), the Explanatory Notes appear in the proposition for the Assembly to make that enactment. Once the enactment comes into force a link to the proposition will be included in the “Table of Legislation History” in the endnotes of the current version of the enactment on the JLIB website. (The reasons for making the enactment should be set out in the Report section of the same proposition.)

  • For an Order (or other enactment not made by the Assembly), the Explanatory Notes appear near the end of the Order Paper for the next meeting of the Assembly after the making of that enactment. (If the enactment is an Order, the reasons for making it should be set out in a Ministerial Decision on the website of the Government of Jersey.)

The notices were formerly Gazetted under Article 3 of the Official Publications (Jersey) Law 1960. That Article is repealed by paragraph 3 of Schedule 2 to the Legislation (Jersey) Law 2021, which comes into force on 28 September 2021. Under Article 16 of the Legislation (Jersey) Law 2021, the Principal Legislative Drafter must ensure that all as-enacted legislation is published. Under the definition of “publish” in Article 1 of that Law, the publication must be by making the legislation available, on an on-going basis, on a website that provides access to the legislation free of charge.

Legislation (Commencement of Law) (Jersey) Act 2021 R&O.112/2021

This Act was made by the States on Thursday 16 September 2021 and came into force forthwith. The Act brings the Legislation (Jersey) Law 2021 into force on Tuesday 28 September 2021. The Legislation Law brings together and supplements provisions concerning:

  • the making, commencement and repeal of legislation;
  • its consolidation, revision and publication; and
  • the Legislative Drafting Office and functions of the Principal Legislative Drafter.
Act declaring that the Income Tax (Amendment – Stage 1 of Independent Taxation) (Jersey) Law 202- has immediate effect R&O.111/2021

This Act was made by the States on Wednesday 15 September 2021 and came into force forthwith. The Act gives immediate effect to the Income Tax (Amendment – Stage 1 of Independent Taxation) (Jersey) Law 202- (P.78/2021), (adopted by the States on Wednesday 15 September 2021), as if it were a Law sanctioned by the Privy Council and registered in the Royal Court.

Finance (2020 Budget) (Jersey) Law 2020 (Appointed Day) Act 2021 R&O.110/2021

This Act was made by the States on Wednesday 15 September 2021 and came into force forthwith. The Act brings into force Article 32 of the Finance (2020 Budget) (Jersey) Law 2020 on 1 January 2022. 

Road Traffic (St. Helier) (Amendment No. 37) (Jersey) Order 2021 R&O.109/2021
This Order was made by the Minister for Infrastructure on Monday 13 September 2021 and comes into force on Monday 20 September 2021. This Order amends the Road Traffic (St. Helier) (Jersey) Order 1996 by specifying parts of Albert Place where parking is prohibited or limited to one hour and specifying a part of Le Quai aux Marchands where parking is limited to 2 hours.

Emergency Powers and Planning (Medicines and Vaccines - Covid-19 and Influenza) (Fourth Period) (Jersey) Order 2021 R&O.108/2021

This Order was made by the Minister for Health and Social Services on Tuesday 24 August 2021 and comes into force on Sunday 5 September 2021. This Order provides for the continuation of relaxed controls on medicines to facilitate a plan for vaccination against Covid-19. This Order also reintroduces provision for vaccination against influenza on the basis that the time period overlaps with the annual influenza vaccination period. The Order expires 3 months after it comes into force (under the Emergency Powers and Planning (Jersey) Law 1990 it cannot remain in force for longer unless renewed). 

Covid-19 (Workplace - Twenty-Sixth Extension) (Jersey) Order 2021 R&O.107/2021

This Order was made by the Minister for Health and Social Services on Tuesday 24 August 2021 and comes into force on Wednesday 1 September 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 30 September 2021.

Covid-19 (Gathering Control Repeal and Workplace Restrictions Amendment) (Jersey) Order 2021 R&O.106/2021

This Order was made by the Minister for Health and Social Services on Tuesday 24 August 2021 and comes into force on Thursday 26 August 2021. This Order further relaxes the restrictions imposed to control the spread of Covid-19 in Jersey while extending the contact tracing requirements. This Order repeals the Covid-19 (Gathering Control) (Jersey) Order 2020, thereby removing the remaining restrictions on gathering, which were limited to gathering in homes and gardens. It also amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020.

Animal Health (Miscellaneous Amendments – Diseases) (Jersey) Order 2021 R&O.105/2021

This Order was made by the Assistant Minister, for and on behalf of the Minister for the Environment, on Friday 13 August 2021 and comes into force on Friday 20th August 2021. This Order amends the Animal Health (Jersey) Law 2016 and the Animal Health (Miscellaneous Exotic Diseases) (Jersey) Order 2017 to add further diseases and pathogens.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Belarus) (Jersey) Order 2021 R&O.104/2021

This Order was made by the Minister for External Relations and Financial Services on Wednesday 11 August 2021 and came into force on Thursday 12 August 2021. This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Republic of Belarus (Sanctions) (EU Exit) (Amendment) Regulations 2021 of the United Kingdom (S.I. 2021/922).

Road Traffic (St. Lawrence) (Amendment No. 26) (Jersey) Order 2021 R&O.103/2021

This Order was made by the Minister for Infrastructure on Tuesday 10 August 2021 and comes into force on Tuesday 17 August 2021. This Order amends the Road Traffic (St. Lawrence) (Jersey) Order 1990 in relation to La Rue de Haut by amending the designated parking areas and restrictions in that road and inserting a new restriction which excludes all vehicles wider than 6 feet 6 inches from being driven in La Ruelle de St. Claire in place of the current restriction which excludes only chars-à-banc.

Education (Grants and Allowances) (Academic Year 2021-2022) (Jersey) Order 2021 R&O.102/2021

This Order was made by the Minister for Children and Education on Friday 6 August 2021 and comes into force on Saturday 7 August 2021. This Order provides, in respect of the academic year 2021-2022 only, for the determination of applications for grants or allowances based on a student’s single parent’s income only. This Order also makes a minor amendment to Article 2 of the Education (Grants and Allowances) (Jersey) Order 2018 to change a reference to the Minister for Children and Housing to the Minister for Children and Education.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 8) (Jersey) Order 2021 R&O.101/2021

This Order was made by the Minister for Health and Social Services on Wednesday 4 August 2021 and comes into force on Friday 5 August 2021. This Order mainly reduces the restrictions on gatherings imposed by the Covid-19 (Gathering Control) (Jersey) Order 2020, though it also makes minor changes to some definitions in the Covid-19 (Workplace Restrictions) (Jersey) Order 2020.

Control of Housing and Work (Temporary Exemption) (Jersey) Order 2021 R&O.100/2021

This Order was made by the Deputy Assistant Chief Minister, for and on behalf of the Chief Minister, on Thursday 29 July 2021 and comes into force on Thursday 5 August 2021. This Order provides that, for the period beginning when the Order comes into force and ending at the end of 31 October 2021, certain additional persons are to be disregarded for the purposes of complying with any condition which appears on a business licence granted under Article 27(1)(a) of the Control of Housing and Work (Jersey) Law 2012, concerning the maximum number of individuals with Licensed or Registered status who are permitted to work for an undertaking.

Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Amendment No. 2) (Jersey) Order 2021 R&O.99/2021

This Order was made by the Assistant Minister, for and on behalf of the Minister for the Environment, on Monday 2 August 2021 and comes into force on Monday 9 August 2021. This Order amends the Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Jersey) Order 2019 so that in 2021 the specified period, during which fishing for protected spider crabs is restricted, runs from the start of 1 September 2021 to the end of 15 October 2021.

Covid-19 (Gathering Control – Ninth Extension) (Jersey) Order 2021 R&O.98/2021

This Order was made by the Minister for Health and Social Services on Friday 30 July 2021 and comes into force on Sunday 1 August 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Tuesday 31 August 2021.

Covid-19 (Workplace – Twenty-Fifth Extension) (Jersey) Order 2021 R&O.97/2021

This Order was made by the Minister for Health and Social Services on Friday 30 July 2021 and comes into force on Sunday 1 August 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Tuesday 31 August 2021.

Access to Justice (Legal Aid Guidelines) (Jersey) Order 2021 R&O.96/2021

This Order was made by the Chief Minister on Tuesday 27 July and comes into force on Tuesday 3 August. This Order makes provision for the publication of draft Legal Aid Guidelines (the “Guidelines”) and the manner in which representations on those Guidelines may be made. In particular, it provides that the Chief Minister must provide a copy of the Guidelines to the relevant Scrutiny Panel, the Jersey Citizens Advice Bureau Limited and the Jersey Consumer Council. The Chief Minister must publish the proposed Guidelines along with a notice stating: that the Guidelines are available; the time period in which representations may be made (which must be a minimum period of 8 weeks); and a postal and email address at which representations will be accepted. 

Constitution of the States and Public Elections (Jersey) Law 2021 L.11/2021 

This Law was registered in the Royal Court on Friday 23 July 2021 and comes into force in accordance with Article 10 of the Law. The Law amends the constitution of the States Assembly by removing Senators and increasing the number of Deputies, with effect from 22 June 2022. It also replaces the current Schedule of Deputies’ constituencies. The Law provides for the next ordinary election of Deputies and Connétables to be held on 22 June 2022, with subsequent ordinary elections to take place every 4 years after that. The Law makes related changes to the provisions for the term of office for both Deputies and Connétables.

States of Jersey Police Force (Amendment No. 3) (Jersey) Law 2021 L.10/2021

This Law was registered in the Royal Court on Friday 23 July 2021 and comes into force on Friday 30 July 2021. The Law amends the States of Jersey Police Force Law 2012 to realign the governance powers and duties of the Minister, the Jersey Police Authority and the Chief Officer; change the membership of the Police Authority; require regular inspection of the States Police Force and also require the Annual Policing Plan to cover 4 years, rather than one.

States of Jersey (Amendment No. 9) Law 2021 L.9/2021

This Law was registered in the Royal Court on Friday 23 July 2021 and comes into force on Friday 30 July 2021. The Law amends the States of Jersey Law 2005 to make provision for parliamentary privilege and connected purposes.

Legislation (Jersey) Law 2021 L.8/2021

This Law was registered in the Royal Court on Friday 23 July 2021 and comes into force on a day to be appointed by Act of the States. The Law brings together and supplements provisions covering: the making, commencement and repeal of legislation; its consolidation, revision and publication; and the Legislative Drafting Office and functions of the Principal Legislative Drafter.

Covid-19 (Enabling Provisions) (Amendment No. 2) (Jersey) Law 2021 L.7/2021

This Law was registered in the Royal Court on Friday 23 July 2021 and comes into force on Saturday 24 July 2021. The Law amends the Covid-19 (Enabling Provisions) (Jersey) Law 2020, for the second time, to extend its operation to 31 March 2022.

Criminal Procedure (Jersey) Law 2018 (Appointed Day) (No. 4) Act 2021 R&O.95/2021

This Act was made by the States on Thursday 22 July 2021 and came into force forthwith. The Act brings into force all remaining uncommenced provisions of the Criminal Procedure (Jersey) Law 2018 on 1 October 2021. 

Criminal Procedure (Consequential and Supplementary Amendments) (Jersey) Regulations 2021 R&O.94/2021

These Regulations were made by the States on Thursday 22 July 2021 and come into force at the same time as Article 103 of the Criminal Procedure (Jersey) Law 2018. These Regulations make amendments that are consequential or supplementary to the Criminal Procedure (Jersey) Law 2018, to update references in other enactments to criminal procedure by substituting new equivalents.

Criminal Procedure (Juries – Tirage) (Jersey) Regulations 2021 R&O.93/2021

These Regulations were made by the States on Thursday 22 July 2021 and come into force at the same time as Article 64 of the Criminal Procedure (Jersey) Law 2018. These Regulations will replace the Criminal Procedure (Tirage) Rules 2002. In particular, these Regulations –

  • set out the information that must be given to the Viscount by each electoral administrator, and how that information must be provided to the Viscount;
  • provide that the Viscount is to compile the information provided and use it to generate a panel list (and, if they think it expedient, a supplementary panel list), and from those lists is to compile a primary and secondary list of persons who may be summoned for jury service; 
  • provide that the Viscount is a public authority under the Register of Names and Addresses (Jersey) Law 2012, and that the Viscount and the electoral administrators may use registrable facts under that Law in order to carry out their functions under Regulations 2 and 3.

Access to Justice (Jersey) Law 2019 (Appointed Day) Act 2021 R&O.91/2021

This Act was made by the States on Wednesday 21 July 2021 and came into force forthwith. The Act brings into force Articles 1, 6, 7, 8 and 9 of the Access to Justice (Jersey) Law 2019 on the day after this Act is made. The remaining provisions of that Law, other than Article 11, come into force on the day on which the first Legal Aid Guidelines published by the Minister come into effect.

Discrimination (Amendment of Law) (Jersey) Regulations 2021 R&O.89/2021

These Regulations were made by the States on Wednesday 21 July 2021 and come into force on Wednesday 28 July 2021. These Regulations outlaw discrimination against people with children in respect of finding places to live.

Covid-19 (Workplace Restrictions) (Amendment No. 13) (Jersey) Order 2021 R&O.88/2021

This Order was made by the Minister for Health and Social Services on Tuesday 20 July 2021 and comes into force on Wednesday 21 July 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to restore earlier requirements for visitors to workplaces to wear masks, for workers to wear masks or visors in workplaces and to make other minor changes. The Order –

  • reintroduces the requirements to wear masks in a variety of public locations that applied before the requirements were limited to public transport vehicles and premises on 14 June 2021. The exception for eating and drinking when sitting at a table in food and drink premises is extended to when in a seat of an auditorium or stadium and a new requirement to wear masks is added when attending an event at a community hall;
  • reintroduces the requirements for workers to wear masks or visors that applied before they were limited to public transport vehicles and premises on 14 June 2021. There are minor changes to limit mask-wearing to indoor areas of markets, amusement centres, entertainment facilities and auction houses to match the requirements for visitors to wear masks in those workplaces. A similar new requirement to that mentioned above for events in community halls is also added;
  • removes the exemption in respect of mask-wearing that applied to certain gatherings of children in workplaces.

Proceeds of Crime (Cannabis Exemption – List of Jurisdictions) (Jersey) Order 2021 R&O.87/2021

This Order was made by the Minister for External Relations and Financial Services on Wednesday 7 July 2021 and came into force on the same day. This Order provides the list of jurisdictions referred to in the definition of “criminal conduct” in the Proceeds of Crime (Jersey) Law 1999 (the “Law”) in respect of which the lawful production, supply, use, export or import of cannabis and any of its derivatives occurring in such a jurisdiction would not be criminal conduct under the Law.

Covid-19 (Election of Jurats) (Jersey) Regulations 2021 R&O.86/2021

These Regulations were made by the States on Wednesday 30 June 2021 and come into force on Thursday 1 July 2021. These Regulations make temporary provision to vary the procedure for the election of jurats due to Covid-19.

Restriction on Smoking (Standardised Packaging and Labelling) (Jersey) Regulations 2021 R&O.85/2021

These Regulations were made by the States on Wednesday 30 June 2021 and come into force on 31 July 2021. These Regulations make provision for standardised packaging for tobacco products and for the use of combined health warnings on tobacco packaging.

Proceeds of Crime (Miscellaneous Amendments No. 2) (Jersey) Regulations 2021 R&O.84/2021

These Regulations were made by the States on Wednesday 30 June 2021 and come into force in accordance with Regulation 4. These Regulations amend the Proceeds of Crime (Jersey) Law 1999 (PoC Law) to provide that Part 2 of the PoC Law applies to a gift made into a trust, as long as certain conditions are met. The Regulations also amend the Proceeds of Crime (Enforcement of Confiscation Orders) (Jersey) Regulations 2008, which modifies the PoC Law, in order that the amendments to the Law apply equally to external confiscation orders.

Income Support (Amendment No. 21) (Jersey) Regulations 2021 R&O.83/2021

These Regulations were made by the States on Wednesday 30 June 2021 and come into force in accordance with Regulation 4. These Regulations amend the Income Support (Jersey) Regulations 2007 in order to increase the rates payable for various components of income support as follows:

on 1st October 2021 –

• the first child component by £5.04;

• the childcare cost component for a child 3 years or age or over from £5.57 per hour to £6.70 per hour;

• the childcare cost component for a child under 3 years of age from £7.14 per hour to £8.00 per hour;

• all other components, save the single parent component, by 1.1%,

• and on 1st October 2022, increase all components, other than the single parent component, by 2.6%.

Proceeds of Crime (Amendment of Law) (No. 2) (Jersey) Regulations 2021 R&O.82/2021

These Regulations were made by the States on Wednesday 30 June 2021 and come into force on Wednesday 7 July 2021. These Regulations amend the Proceeds of Crime (Jersey) Law 1999 to exclude the production, supply, use, export or import of cannabis and any of its derivatives that is lawful where and when it occurs and occurs in a jurisdiction outside Jersey that the Minister for External Relations and Financial Services may by Order specify.

Covid-19 (Gathering Control – Eighth Extension) (Jersey) Order 2021 R&O.81/2021

This Order was made by the Minister for Health and Social Services on Wednesday 30 June 2021 and comes into force on Wednesday 1 July 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Saturday 31 July 2021.

Covid-19 (Workplace – Twenty-Fourth Extension) (Jersey) Order 2021 R&O.80/2021

This Order was made by the Minister for Health and Social Services on Wednesday 30 June 2021 and comes into force on Wednesday 1 July 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Saturday 31 July 2021.

Termination of Pregnancy (Amendment No. 2) (Jersey) Law 2021 L.6/2021

This Law was registered in the Royal Court on Friday 25 June 2021 and comes into force on Friday 2 July 2021. The Law amends the Termination of Pregnancy (Jersey) Law 1997 in order to remove the 7 day minimum waiting period between the first and second medical consultations for a pregnant woman seeking a termination.

Road Traffic (St. Helier) (Amendment No. 36) (Jersey) Order 2021 R&O.79/2021

This Order was made by the Minister for Infrastructure on Friday 11 June 2021 and comes into force on Friday 18 June 2021. This Order amends road restrictions in the parish of St. Helier relating to one-way traffic, prohibition of waiting, designated parking places on roads, the St. Helier residential and business parking zones and the places in roads where vehicles can load and unload.  It also increases the fees for a resident parking permit and a business parking permit by approximately 10%.  These fees were last increased with effect from 1 May 2015.

Road Traffic (St. Clement) (Amendment No. 25) (Jersey) Order 2021 R&O.78/2021

This Order was made by the Minister for Infrastructure on Friday 11 June 2021 and comes into force on Friday 18 June 2021. This Order amends the Road Traffic (St. Clement) (Jersey) Order 1987 in relation to the parking of vehicles in La Grande Route de St. Clement, La Rue de la Croix and La Grève d’Azette; restricting vehicles wider than 6 feet and 6 inches from being driven in specified roads and making various drafting changes by way of clarification and minor improvements.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 7) (Jersey) Order 2021 R&O.77/2021

This Order was made by the Minister for Health and Social Services on Friday 11 June 2021 and comes into force on Monday 14 June 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to further relax the restrictions imposed to control the spread of Covid-19 in Jersey while extending the contact tracing requirements and making a few minor changes. The Order –

  • removes the requirements on visitors to workplaces to wear masks except in the case of public transport vehicles and premises;
  • provides for the removal of the requirements for workers to wear masks or visors except in the case of public transport vehicles and premises;
  • extends the contact tracing requirements to apply to ritual gatherings of whatever size and various gatherings in community halls;
  • extends the category of enforcement officer to cover all States’ employees employed as enforcement officers within the Covid Safe team.

This Order also amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to remove the restriction on numbers in the case of a wedding or civil partnership celebration taking place at a person’s home.

Road Traffic (No. 67) (Jersey) Regulations 2021 R&O.76/2021

These Regulations were made by the States on Wednesday 9 June 2021 and come into force on Wednesday 16 June 2021. These Regulations further amend the Road Traffic (Jersey) Law 1956, chiefly to enable the introduction of penalty charges in respect of parking contraventions in place of criminal proceedings.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Third Period) (Jersey) Order 2021 R&O.75/2021

This Order was made by the Assistant Minister, for and on behalf of the Minister for Health and Social Services, on Wednesday 2 June 2021 and comes into force on Saturday 5 June 2021. This Order is a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 which relaxes controls on medicines to facilitate a plan for vaccination against Covid-19, which in turn was a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020. The Order expires 3 months after it comes into force (under the Emergency Powers and Planning (Jersey) Law 1990 it cannot remain in force for longer unless renewed). This Order will expire at the end of 4 September 2021.

Taxation (Companies – Economic Substance) (Amendment No. 2) (Jersey) Law 2021 L.5/2021

This Law was registered in the Royal Court on Friday 28 May 2021 and comes into force on Friday 4 June 2021. The Law amends the Taxation (Companies – Economic Substance) (Jersey) Law 2019 by inserting a requirement that a self-managed fund must satisfy the economic substance test.

Wildlife (Jersey) Law 2021 L.4/2021

This Law was registered in the Royal Court on Friday 28 May 2021 and comes into force on Friday 4 June 2021. The Law revises and updates the statutory protection of Jersey wildlife (that is, animals, birds and plants), makes new provision to control invasive non-native species, and creates a new duty for public bodies to promote biodiversity in Jersey.

Road Traffic (St. Peter) (Amendment No. 11) (Jersey) Order 2021 R&O.74/2021

This Order was made by the Minister for Infrastructure on Friday 28 May 2021 and comes into force on Friday 4 June 2021. This Order amends the Road Traffic (St. Peter) (Jersey) Order 1992 with the effect of prohibiting the parking of vehicles in parts of Le Vieux Beaumont and restricting the parking of vehicles in a section of that road to a maximum of 12 hours in a period of 24 hours.

Mental Health (Miscellaneous Provisions and Prescribed Forms) (Amendment No. 2) (Jersey) Order 2021 R&O.73/2021

This Order was made by the Minister for Health and Social Services on Tuesday 25 May 2021 and comes into force on Tuesday 1 June 2021. This Order amends the Mental Health (Miscellaneous Provisions and Prescribed Forms) (Jersey) Order 2018. The amendment allows the Minister to attach a condition to the approval of the appointment of a registered medical practitioner (“doctor”) as an approved practitioner under the Mental Health (Jersey) Law 2016 to limit it to appointment as a medical member of the Mental Health Review Tribunal, provided a certain requirement is fulfilled.

Covid-19 (Workplace Restrictions) (Amendment No. 12) (Jersey) Order 2021 R&O.70/2021

This Order was made by the Minister for Health and Social Services on Monday 17 May 2021 and comes into force on Tuesday 18 May 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to widen the purposes for which food and drink premises may be open. In the case of food and drink premises that are part of wider premises that include an auditorium or a stadium, the premises may be open for the purpose of selling food or drink (other than alcoholic drinks) to customers for consumption in the auditorium or stadium.  Otherwise the food or drink must be sold to be taken outside the wider premises or to be consumed at a table in the premises.

Immigration (Fees) (Amendment No. 6) (Jersey) Order 2021 R&O.69/2021

This Order was made by the Assistant Minister, for and on behalf of the Minister for Home Affairs, on Monday 10 May 2021 and comes into force on Tuesday 11 May 2021. This Order inserts 2 new definitions (“seasonal employment” and “sector-based employment”) into the Immigration (Fees) (Jersey) Order 2017 and amends the table of fees in Article 2.

Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Amendment No. 3) (Jersey) Order 2021 R&O.68/2021

This Order was made by the Minister for Infrastructure on Monday 10 May 2021 and comes into force on Monday 31 May 2021. This Order amends the Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Jersey) Order 2003 so as to require all cabs, apart from limousine taxi-cabs, to be compliant with conditions so that they can be used by persons with a disability.

Motor Traffic (Cabs – General) (Jersey) Order 2021 R&O.67/2021

This Order was made by the Minister for Infrastructure on Monday 10 May 2021 and comes into force on Monday 31 May 2021. This Order repeals the Motor Traffic (Taxi-Cabs – General) (Jersey) Order 2002 and replaces it with conditions of use which remove the current distinction between private-hire cabs and taxis. There are no longer different conditions of use depending on whether the public service licence in force in respect of a vehicle restricts the use of taxi ranks (currently the case with private-hire vehicles) or allows taxi ranks to be used without restriction (currently the case with taxis). Limousines providing cab services are unaffected.

Road Traffic (Miscellaneous Amendments – Coastguard Vehicles) (Jersey) Order 2021 R&O.66/2021

This Order was made by the Minister for Infrastructure on Monday 10 May 2021 and comes into force on Monday 17 May 2021. This Order amends 3 Orders under the Road Traffic (Jersey) Law 1956 so that various requirements under that Law, including the requirement to comply with traffic lights, do not apply to vehicles used for emergency purposes by the Jersey Coastguard service. The provisions are similar to those that already exist for vehicles used by ambulance, fire and rescue and police services.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 6) (Jersey) Order 2021 R&O.65/2021

This Order was made by the Minister for Health and Social Services on Friday 7 May 2021 and comes into force on Monday 10 May 2021. This Order makes further relaxations to the restrictions imposed as a consequence of Covid-19. The Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to remove the final category of workplace which had to be closed for all purposes, namely jacuzzies, plunge pools, steam rooms, saunas, Turkish baths, and the like. These workplaces are now able to open for all purposes. The Order also amends the Covid-19 (Gathering Control) (Jersey) Order 2020. The definition “open air” is amended to include structures open on half of their sides. The restriction on gathering in private gardens is extended to cover 50 people aged 5 and over for outdoor wedding and civil partnership receptions as well as celebrations. There are now no limits on numbers gathering in private gardens previously hired out or booked for hire by non-family members before the Order came into force. These provisions apply to all outdoor spaces associated with homes, including marquees or other temporary structures placed there.

Planning and Building (General Development) (Amendment No. 7 – Covid‑19) (Jersey) Order 2021 R&O.64/2021

This Order was made by the Minister for the Environment on Tuesday 4 May 2021 and comes into force on Wednesday 5 May 2021. This Order amends Schedule 1 to the Planning and Building (General Development) (Jersey) Order 2011, which gives general permission for temporary development in respect of emergency medical and related facilities for government to deal with the Covid-19 pandemic. The effect of the amendment is to add a further year to the limitation of time for the developments and changes of use of land, allowing the facilities which have been temporarily created to remain in place until May 2022.

Finance (2021 Budget) (Jersey) Law 2021 L.3/2021

This Law was registered in the Royal Court on Friday 30 April 2021 and came into force on 1 January 2021 by Act (R&O.167/2020). The Law sets the standard rate of tax for 2021 and amends a series of finance-related legislation in order to implement parts of the Government Plan for 2021.

Pedal Cycles (Amendment No. 4) (Jersey) Order 2021 R&O.60/2021

This Order was made by the Minister for Infrastructure on Wednesday 28 April 2021 and comes into force on Wednesday 5 May 2021. This Order amends the Pedal Cycles (Jersey) Order 1998 by changing the requirements for a bicycle or tricycle to be classed as an “electrically assisted pedal cycle” and not a “motor vehicle” under the Road Traffic (Jersey) Law 1956 .

Covid-19 (Workplace Restrictions) (Amendment No. 11) (Jersey) Order 2021 R&O.58/2021

This Order was made by the Minister for Health and Social Services on Wednesday 28 April 2021 and comes into force on Friday 30 April 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to remove the requirement for food and drink premises to close by 11.30 p.m. It does not remove the requirement that the food and drink (other than to take away) are consumed only while seated at a table, or the requirement for customers to wear masks indoors while not seated at a table. It also does not affect any other legal obligation to close at a certain time, such as for premises holding an alcohol licence.

Control of Housing and Work (Exemptions) (Amendment No. 5) (Jersey) Order 2021 R&O.56/2021

This Order was made by the Chief Minister on Tuesday 27 April 2021 and comes into force on Tuesday 4 May 2021. This Order amends the Control of Housing and Work (Exemptions) (Jersey) Order 2013 to implement obligations under the World Trade Organisation General Agreement on Trade in Services (GATS) relating to business visitors in Jersey for establishment purposes.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Corruption) (Jersey) Order 2021 R&O.55/2021

This Order was made by the Minister for External Relations and Financial Services on Monday 26 April 2021 and comes into force on Tuesday 27 April 2021. This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Global Anti-Corruption Sanctions Regulations 2021 of the United Kingdom. Those Regulations revoke the Misappropriation (Sanctions) (EU Exit) Regulations 2020, and impose asset freezes and immigration sanctions on persons designated by the United Kingdom on the basis of suspected involvement in (or association with persons involved in) serious bribery or serious misappropriation of property.

Sea Fisheries (TCA – Licensing of Fishing Boats) (Amendment of Law and Regulations) (Jersey) Regulations 2021 R&O.54/2021

These Regulations were made by the States on Friday 23 April 2021 and come into force on Friday 30 April 2021. These Regulations amend the Sea Fisheries (Jersey) Law 1994 and the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003 to make the changes necessary to implement the Trade and Cooperation Agreement between the United Kingdom and the European Union as it applies to Jersey.

Illegal, Unreported and Unregulated Fishing (Jersey) Regulations 2021 R&O.53/2021

These Regulations were made by the States on Friday 23 April 2021 and come into force on Friday 30 April 2021. These Regulations implement, with the modifications necessary for it to apply in Jersey, Council Regulation (EC) No 1005/2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing.

Covid-19 (Amendments – Extension and Suspension) (Jersey) Regulations 2021 R&O.52/2021

These Regulations were made by the States on Friday 23 April 2021 and come into force on Thursday 29 April 2021. These Regulations make amendments to temporary provisions for Covid-19 in several items of legislation, to extend the expiry dates of those provisions from the end of 30 April 2021 to the end of 31 October 2021. Most of the provisions were previously extended from 30 September 2020 by the Covid-19 (Amendments – Extension, Suspension and Repeal) (Jersey) Regulations 2020.

Public Holidays and Bank Holidays (Amendment No. 3) (Jersey) Act 2021 R&O.50/2021

This Act was made by the States on Thursday 22 April 2021 and comes into force on Thursday 29 April 2021. The Act amends Part 2 of the Schedule to the Public Holidays and Bank Holidays (Jersey) Act 2010 to make provision for Monday 27 September 2021 to be observed as a public holiday, in recognition of the 250th anniversary of the Code of 1771, and to remove a reference to an obsolete public holiday.

Intellectual Property (Unregistered Rights) (Amendment – Disability and Rights in Performances) (Jersey) Regulations 2021 R&O.49/2021

These Regulations were made by the States on Wednesday 21 April 2021 and come into force on Wednesday 28 April 2021. These Regulations amend the Intellectual Property (Unregistered Rights) (Jersey) Law 2011 to expand the provisions in relation to accessible copies of copyright works and recordings of performances for visually impaired people so that they apply to a wider class of disabled people.

Road Traffic (No. 66) (Jersey) Regulations 2021 R&O.48/2021

These Regulations were made by the States on Wednesday 21 April 2021 and come into force on Wednesday 28 April 2021. These Regulations amend the Road Traffic (Jersey) Law 1956 so that traffic lights and other traffic restrictions need not apply to vehicles used for emergency purposes by the Jersey Coastguard service.

Covid-19 (Safe Distancing – Suspension No. 2) (Jersey) Order 2021 R&O.47/2021

This Order was made by the Minister for Health and Social Services on Friday 9 April 2021 and comes into force on Monday 12 April 2021. This Order is made under Regulation 6(4) of the Covid-19 (Safe Distancing) (Jersey) Regulations 2020, to suspend indefinitely the effect of Regulations 2(2) and 3(1) of those Regulations. The suspended provisions contain the only criminal offences in the Regulations, and the effect of the suspension is that there is no criminal sanction in respect of breaches of safe distancing under the Regulations. The suspension is for an indefinite period, so it lasts until this Order is repealed. But the Regulations themselves are due to expire at the end of 30 April 2021, although P.25/2021 has been lodged to propose extending that date to the end of 31 October 2021. The offences will fall away on the expiry date in any case, whenever that might be.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 5) (Jersey) Order 2021 R&O.46/2021

This Order was made by the Minister for Health and Social Services on Friday 9 April 2021 and comes into force on Monday 12 April 2021. This Order further relaxes the restrictions imposed by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 and the Covid-19 (Gathering Control) (Jersey) Order 2020.

Communications (Television Licensing) (Amendment) Regulations 2021 R&O.45/2021

These UK Regulations, which apply to Jersey, were registered in the Royal Court on Friday 9 April 2021 and came into force on 1 April 2021. These Regulations increase the amount payable for various categories of TV licence.

Control of Housing and Work (Fees) (Amendment No. 3) (Jersey) Order 2021 R&O.44/2021

This Order was made by the Chief Minister on Thursday 1 April 2021 and comes into force on Thursday 8 April 2021. This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013  so that the definition “employment agencies” includes businesses which supply persons employed by that business to work for any other business (commonly referred to as “temp agencies”).

Covid-19 (Workplace Restrictions) (Amendment No. 10) (Jersey) Order 2021 R&O.43/2021

This Order was made by the Minister for Health and Social Services on Wednesday 31 March 2021 and comes into force on Friday 2 April 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 in relation to food and drink premises, but only in relation to consumption on the premises.
This Order extends to 11 p.m. the time until which the food or drink may be ordered, and to 11.30 p.m. the time by which the food or drink must be consumed. It removes the requirement for customers to be seated at a table while ordering or paying for the food or drink (but retains the seating requirement while consuming the food or drink, and retains the separate limit of 10 customers per table). It removes the requirement for alcoholic drinks to be ordered with a meal. Lastly it broadens the exception from wearing a mask, so that the customer can remove the mask for all of the time spent sitting at the table at which the food or drink is to be consumed.

Covid-19 (Gathering Control – Fifth Extension) (Jersey) Order 2021 R&O.42/2021

Social Security (Contributions) (Covid‑19) (Amendment No. 3) (Jersey) Order 2021 R&O.40/2021

This Order was made by the Minister for Social Security on Friday 26 March 2021 and comes into force on Tuesday 30 March 2021. This Order amends the Social Security (Contributions) (Covid 19) (Jersey) Order 2020 (the “principal Order”).
This Order amends the principal Order as follows:
(a)  amends Article 1 of the principal Order, to define Quarter A 2021 as the period of 3 months beginning 1st January 2021 and to delete the definition “Department” – all references to “Department” throughout the Order are replaced with “Minister”;
(b)  amends Article 2 of the principal Order, to provide that an employer required to make a Class 1 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months;
(c)  amends Article 3 of the principal Order, to provide that an insured person required to pay a Class 2 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months;
(d)  amends Article 4 of the principal Order, to clarify that recovery of a relevant benefit may be made for any relevant benefit paid which is based on a quarter deferred under Article 3 of the principal Order, and that the Minister may seek to recover survivor’s benefit from the survivor of a person who makes a deferral under that Article 3.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 4) (Jersey) Order 2021 R&O.39/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 March 2021 and comes into force on Friday 26 March 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 and the Covid-19 (Gathering Control) (Jersey) Order 2020 to relax the numbers allowed for certain gatherings whilst imposing additional requirements on those gatherings where they take place in workplaces.

Income Tax (Payment of 2019 Liability) (Jersey) Regulations 2021 R&O.38/2021

These Regulations were made by the States on Tuesday 23 March 2021 and come into force on Tuesday 30 March 2021. These Regulations determine when taxpayers, whose 2019 income tax liability has been deferred, must pay that liability. The deferral of the 2019 income tax liability for some taxpayers was a result of the removal of the prior year basis method of paying tax.

Road Traffic (No. 65) (Jersey) Regulations 2021 R&O.37/2021

These Regulations were made by the States on Tuesday 23 March 2021 and come into force on a day to be specified by an Order of the Minister for Infrastructure. These Regulations amend the Road Traffic (Jersey) Law 1956 in respect of driving licences.

Planning and Building (Covid-19 Bridging Island Plan) (Jersey) Order 2021 R&O.36/2021

This Order was made by the Minister for the Environment on Monday 22 March 2021 and comes into force on Tuesday 23 March 2021. This Order provides for the procedures (in particular, the examination in public) relating to the introduction of a relatively short-term, bridging Island Plan in the circumstances created by the Covid-19 emergency and its aftermath.

Road Traffic (St. Martin) (Amendment No. 12) (Jersey) Order 2021 R&O.35/2021

This Order was made by the Minister for Infrastructure on Wednesday 17 March 2021 and comes into force on Wednesday 24 March 2021. This Order amends the Road Traffic (St. Martin) (Jersey) Order 1989 by prohibiting the parking of vehicles in specified parts of La Rue de la Mare des Reines and La Rue des Vaux de L’Eglise in the parish of St. Martin.

Motor Vehicles (Wearing of Seat Belts by Adults) (Amendment No. 2) (Jersey) Order 2021 R&O.34/2021

This Order was made by the Minister for Infrastructure on Wednesday 17 March 2021 and comes into force on Wednesday 24 March 2021. This Order amends the Motor Vehicles (Wearing of Seat Belts by Adults) (Jersey) Order 2009 so as to add a new exemption from wearing seat belts relating to ambulances and to update and broaden the current exemptions relating to the police and fire and rescue services.

Health Insurance Fund (Miscellaneous Provisions) (Amendment No. 2) (Jersey) Law 2021 L.2/2021

This Law was registered in the Royal Court on Friday 12 March 2021 and comes into force on Friday 19 March 2021. The Law amends the Health Insurance Fund (Miscellaneous Provisions) (Jersey) Law 2011 to allow the withdrawal of £11.3 million from the Health Insurance Fund.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 3) (Jersey) Order 2021 R&O.33/2021

This Order was made by the Minister for Health and Social Services on Friday 12 March 2021 and comes into force on Monday 15 March 2021. This Order makes further amendments to the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the “Workplaces Order”) and the Covid-19 (Gathering Control) (Jersey) Order 2020 (the “Gatherings Order”).

The Workplaces Order is amended as follows:
(a)  relocates 2 definitions to the interpretation Article so they can apply to a wider range of Articles;
(b)  amends Article 2 to remove the requirements for amusement centres, certain changing and shower facilities and indoor play areas to be closed and deletes the definitions of “amusement centre” and “indoor play area” which are relocated as mentioned above;
(c)  widens Article 3 to include opening of workplaces subject to conditions. The restrictions on the opening of changing facilities used in connection with swimming pools or paddling pools are removed. Indoor physical activity facilities, swimming pools and paddling pools are now permitted to be open subject to reasonable steps being taken to assist in controlling the spread of Covid-19. Some redundant provisions are also removed;
(d)  amends Article 5 to vary the requirement for visitors to indoor physical activity facilities to wear masks to apply except while in a part of the facility currently being used for sport, dance or exercise. Mask-wearing is now also required in changing facilities (except while actually changing), indoor play areas and amusement centres;
(e)  makes the same changes in relation to the requirements for workers to wear masks or visors in Article 5A as are made in relation to visitors;
(f)  extends the contact-tracing requirements in Article 5B to indoor physical activity facilities (except in the case of certain gatherings of children), indoor play areas and amusement centres;
(g)  widens the 2-metre distancing requirements in Article 5C to cover indoor physical activity facilities in all circumstances, changing or shower facilities and amusement centres. In the case of changing or shower facilities, the requirement doesn’t apply where the occupier or operator of those premises has taken alternative steps to assist in controlling the spread of Covid-19 through the use of screens that shield people from each other.

The Gatherings Order is amended to remove the limit on numbers in relation to gatherings in certain workplaces, namely indoor physical activity facilities, swimming pools and paddling pools, changing and shower facilities and amusement centres. The amendment also removes the requirement for children’s activity groups to have been establishing in December of last year to fall within the exception and increases the numbers allowed in a controlled gathering in the open air by children or adults for sport or exercise from 35 to 45.

Social Security (Television Licence Benefit – Income Threshold) (Jersey) Order 2021 R&O.32/2021

This Order was made by the Minister for Social Security on Friday 12 March 2021 and comes into force on Friday 19 March 2021. This Order sets the income threshold at which a person is eligible for a television licence benefit. It sets the threshold amount for a single person and for a couple.

Covid-19 (Gathering Control) (Amendment No. 4) (Jersey) Order 2021 R&O.31/2021

This Order was made by the Minister for Health and Social Services on Thursday 4 March 2021 and comes into force on Monday 8 March 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to –
(a)   provide that children under the age of 5 do not count towards the limit of 10 people who may gather in a home (currently only children under the age of 3 do not count);
(b)   introduce a provision that children under the age of 5 do not count towards the limit of 10 people who may gather in the open air;
(c)   provide that children under the age of 5 do not count towards the limit of 10 people who may gather as part of a children’s activity group; and
(d)   enable gatherings of up to 35 people in the open air for the purpose of sport or exercise for adults.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 R&O.30/2021

This Order was made by the Minister for Health and Social Services on Thursday 4 March 2021 and comes into force on Friday 5 March 2021. This Order is a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020 (except in relation to influenza) which relaxes controls on medicines to facilitate a plan for vaccination against Covid-19.

States of Jersey (Minister for Children and Education, Minister for Housing and Communities and Minister for External Relations and Financial Services) (Jersey) Order 2021 R&O.29/2021

This Order was made by the Chief Minister on Tuesday 2 March 2021 and came into force forthwith. This Order renames the Minister for Education as the “Minister for Children and Education” and provides for the related transfer of functions relating to children from the current Minister for Children and Housing. The latter Minister is renamed as the “Minister for Housing and Communities”. The Order also renames the Minister for External Relations as the “Minister for External Relations and Financial Services”.

Road Traffic (Periodic Technical Inspections – General Provisions) (Amendment) (Jersey) Order 2021 R&O.28/2021

This Order was made by the Minister for Infrastructure on Friday 26 February 2021 and comes into force on Friday 5 March 2021. This Order amends the Road Traffic (Periodic Technical Inspections – General Provisions) (Jersey) Order 2018 by postponing for 3 years, from 30 March 2021 until 31 March 2024, the date from which vehicles other than minibuses, light motor cycles and mopeds must have their first periodic technical inspections. The scheme introducing mandatory periodic technical inspections for minibuses, light motor cycles and mopeds started on 30 March 2019. For all other vehicles, the date by which the first periodic technical inspection must be made is 5 years after first use and every subsequent 3 years but any such date is disregarded if it falls before 30 March 2021. This Order changes that date to 31 March 2024.

Covid-19 (Gathering Control – Fourth Extension) (Jersey) Order 2021 R&O.27/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 February 2021 and comes into force on Monday 1 March 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Wednesday 31 March 2021.

Covid-19 (Workplace – Twentieth Extension) (Jersey) Order 2021 R&O.26/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 February 2021 and comes into force on Monday 1 March 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Wednesday 31 March 2021.

Prison (Amendment No. 5) (Jersey) Rules 2021 R&O.25/2021

These Rules were made by the Minister for Home Affairs on Tuesday 23 February 2021 and come into force on Tuesday 2 March 2021. These Rules amend the Prison (Jersey) Rules 2007 to allow a unit manager to inquire into a disciplinary charge against a prisoner (currently, only senior unit managers and above can inquire into a charge).

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 2) (Jersey) Order 2021 R&O.24/2021

This Order was made by the Minister for Health and Social Services on Friday 19 February 2021 and came into force on Monday 22 February 2021. This Order further relaxes the restrictions imposed by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 as follows:
(a)   inserts a definition of “accommodation premises” to cover registered tourism premises (hotels, guest houses, self-catering accommodation, youth hostels and camp sites) and clubs where members can stay;
(b)   removes the restriction on the opening of workplaces used by driving instructors (meaning their vehicles);
(c)   lifts some of the restrictions on the opening of food and drink premises to allow food and drink to be served at tables of up to 10 people till 10 p.m., for premises to be open till 10.30 p.m. and for alcohol to be served if it is ordered at the same time as, or during the consumption of, a meal. In the case of food and drink premises that are also accommodation premises, the time limits do not apply in respect of residents and their guests. Nightclubs are now allowed to be open for the purpose of serving food and drink in accordance with these requirements. Other restrictions applying to licensed premises are removed. Nothing in the whole of Article 3 is to affect any other condition to which a licence is subject;
(d)   limits the requirements for visitors to food and drink premises to wear masks to where the visitor is purchasing or waiting to purchase take-away food or is consuming food or drink on the premises, except while actually eating or drinking. In the case of accommodation premises the visitor must wear a mask in the non-food and drink part of the premises except in the visitor’s own sleeping accommodation. People are also required to wear masks in driving instructors’ vehicles;
(e)   requires workers to wear masks or visors in accommodation premises, and in the case of food premises and accommodation premises, the requirement now applies also while the worker is in the presence of a person working as part of a different workforce to the worker. Driving instructors are also now required to wear masks unless to do so would be unsafe;
(f)   extends the contact tracing requirements to accommodation premises and driving instructors’ vehicles;
(g)   extends the 2 metre distancing requirements to food and drink premises where customers are purchasing or waiting to purchase take-away food or consuming food or drink on the premises. The exceptions are in respect of people who expected to sit at the same table or where the occupier or operator of the premises has deployed screens that shield people from each other. The distancing requirements are also extended to accommodation premises except in the person’s own sleeping accommodation;
(h)   amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to correct a cross-reference and make it clear that the relaxation on gatherings at weddings, funerals and religious services to up to 40 people applies only to the ceremony itself.

Road Traffic (St. Saviour) (Amendment No. 14) (Jersey) Order 2021 R&O.23/2021

This Order was made by the Minister for Infrastructure on Friday 19 February 2021 and comes into force on Saturday 20 February 2021. This Order amends the Road Traffic (St. Saviour) (Jersey) Order 2000 by replacing the current one-way restriction in La Chasse Brunet. That restriction allows traffic to be driven a northerly direction only from the junction with Bagatelle Road to the junction with La Rue de Patier. This Order provides for the one-way restriction to run in the opposite direction, that is, to allow vehicles to be driven only in the direction from the junction with La Rue de Patier to Bagatelle Road.

Education (Grants and Allowances) (Amendment) (Jersey) Order 2021 R&O.22/2021

This Order was made by the Minister for Education on Friday 19 February 2021 and comes into force on Friday 26 February 2021. This Order makes amendments to certain definitions in the interpretation provision of the Education (Grants and Allowances) (Jersey) Order 2018. It also provides for a maximum available grant in respect of a distance learning course, for a maximum duration of a course for which a skills bursary is payable, and adds a further situation in which interview attendance allowance is not payable.

Covid-19 (Gathering Control) (Amendment No. 3) (Jersey) Order 2021 R&O.21/2021

This Order was made by the Minister for Health and Social Services on Tuesday 16 February 2021 and comes into force on Wednesday 17 February 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, following the amendment to that Order made by the Covid-19 (Gathering Control) (Amendment No. 2) (Jersey) Order 2021 (the “Amendment No. 2 Order”). The effect of this amendment is to require a gathering to be in the open air if it is to benefit from the exception for controlled gatherings of up to 35 people for children’s sport or exercise, which was added by the Amendment No. 2 Order.

Covid-19 (Gathering Control) (Amendment No. 2) (Jersey) Order 2021 R&O.20/2021

This Order was made by the Minister for Health and Social Services on Monday 15 February 2021 and comes into force on Wednesday 17 February 2021. This Order amends the current limitations on people gathering that are set out in the Covid-19 (Gathering Control) (Jersey) Order 2020. The effect is to increase the numbers of people who may gather for the celebration of a marriage or civil partnership, at a funeral or part of a service of religious worship from 20 to 40. The Order also allows up to 35 people to gather to enable children to participate in sport or exercise.

Social Security (Contributions) (Covid‑19) (Amendment No. 2) (Jersey) Order 2021 R&O.19/2021

This Order was made by the Minister for Social Security on 7 January 2021 and came into force on 8 January 2021. This Order amends the Social Security (Contributions) (Covid-19) (Jersey) Order 2020 to provide that an employer required to make a Class 1 contribution in respect of the period of 3 months beginning 1 October 2020 (“Quarter D”), or an insured person required to pay a Class 2 contribution in respect of Quarter D, may apply to defer payment of those contributions by up to 24 months. 

Road Traffic (St. Mary) (Amendment No. 3) (Jersey) Order 2021 R&O.18/2021

This Order was made by the Minister for Infrastructure on Friday 12 February 2021 and comes into force on Friday 19 February 2021. This Order amends the Road Traffic (St. Mary) (Jersey) Order 2000 by allowing pedal cycles to be used in both directions along the part of La Rue de la Vallée which is one-way for other vehicles.

Road Traffic (Public Parking Places – Charges) (Amendment No. 5) (Jersey) Order 2021 R&O.17/2021

This Order was made by the Minister for Infrastructure on Friday 12 February 2021 and comes into force on Monday 1 March 2021. This Order increases parking charges in public parking places by a maximum of 1.15%. The parking unit charge is increased except for electric and plug in hybrid electric vehicles. The charges for monthly season tickets are increased, including for electric and plug in hybrid electric vehicles. Excess charges remain unchanged and parking remains free for electric or plug in hybrid electric vehicles for a period of 12 months after first registration in Jersey.

Income Tax (Amendment No. 46) (Jersey) Law 2021 L.1/2021

This Law was registered in the Royal Court on Friday 12 February 2021. Article 8 came into force on 16 November 2020 and the remainder of the Law came into force on 1 January 2021 by Act (R&O.131/2020). The Law amends the Income Tax (Jersey) Law 1961 in order to remove the prior-year basis method of paying income tax.

Covid-19 (Island Plan) (Jersey) Regulations 2021 R&O.16/2021

These Regulations were made by the States on Wednesday 10 February 2021 and come into force on Thursday 11 February 2021. These Regulations amend the Planning and Building (Jersey) Law 2002 to make changes to the process by which the Minister for the Environment lodges policy proposals in respect of the development and use of land in Jersey in the near future. These changes reflect the current uncertainties caused by the Covid-19 pandemic, and are intended to be temporary and finite.

Covid-19 (Workplace Restrictions) (Amendment No. 9) (Jersey) Order 2021 R&O.15/2021

This Order was made by the Minister for Health and Social Services on Tuesday 9 February 2021 and came into force on Wednesday 10 February 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the “2020 Order”).
The Order amends Article 2 of the 2020 Order to allow:
(a)  allows the opening of workplaces used for the purposes of carrying out:
      (i)  activities undertaken by spas, nail salons, beauty salons, waxing salons or tanning salons, or for laser hair removal,
      (ii)  non-surgical cosmetic procedures such as Botox injections and facial fillers,
      (iii)  tattooing, piercing, acupuncture or massage, or
      (iv)  providing haircuts, hair styling or the professional application of make-up;
(b)  requires changing and shower facilities used in connection with indoor or outdoor sport or exercise to be closed whether those facilities are indoors or outdoors; and
(c)  removes the requirement for swimming and paddling pools to be closed in all circumstances (they are now allowed to be open for limited purposes described below).
The Order amends Article 3 of the 2020 Order to allow:
(a)  changing facilities used in connection with swimming pools or paddling pools to be open but only for the purpose of certain children’s activities;
(b)  swimming pools and paddling pools to be open but only for the same purposes as indoor physical activities facilities are allowed to be open;
(c)  licensed premises to be open additionally for the purposes mentioned in (a)(i) to (iv) as in Article 2; and
(d)  indoor physical activity facilities to be open additionally to allow up to 5 high performing athletes to take part in a physical activity along with up to 2 trainers or others instructing the athletes or assisting them with their training or physical fitness.
The Order also limits the requirement to wear masks in indoor physical activity facilities to where they are required to be worn by visitors, namely when access is incidental to the use of outdoor facilities or in connection with therapeutic services. 

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment) (Jersey) Order 2021 R&O.14/2021

This Order was made by the Minister for Health and Social Services on Monday 1 February 2021 and comes into force on Wednesday 3 February 2021.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 as follows:
(a)  replaces the definition of “indoor recreation facility” so that the restrictions imposed apply only to sport, dance or exercise facilities;
(b)  removes the restrictions on the opening of art galleries, auction houses, betting agencies and shops, and the restriction on the opening of entertainment facilities is now limited to the auditorium of those facilities. A restriction is imposed on the opening of changing and shower facilities used in connection with indoor physical activity facilities or outdoor sport or exercise. The restriction on closing of soft play areas is widened to include all indoor play areas;
(c)  removes the partial restrictions on opening of shops markets and libraries, and visitor attractions, except to the extent closed by other provisions;
(d)  the exceptions to the closure of what are now called indoor physical activity facilities are widened to allow certain gatherings of young people permitted by the Covid-19 (Gathering Control) (Jersey) Order 2020, the provision of certain therapeutic services or for horse riding or exercise in an indoor riding arena, one person at a time. The general exceptions to allow workplaces to be open to allow certain essential services to take place is extended to cover the administering of vaccines against any disease;
(e)  alters the requirement for visitors to certain workplaces to wear masks. In the case of indoor physical activity facilities, it is limited to when access is needed in connection with activities in outdoor areas and where therapeutic services are provided. The requirement is also extended to auction houses and betting agencies;
(f)  updates the requirement for workers to wear masks or visors to the new defined term of “indoor physical activity facilities”. It also requires people working at retail premises to wear masks in the presence of visitors and workers who are part of a different workforce as opposed to in all circumstances (as currently required);
(g)  limits the requirement to maintain at least 2 metres distance from other persons in the case of indoor physical activity facilities to when access is needed in connection with activities in outdoor areas. The requirement is also extended to auction houses and betting agencies.

The Order also amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to include within the exception, to allow gatherings of more than 10 in certain circumstances, before and after school activities.
