This privacy notice covers the Low Carbon Heating Incentive, which is delivered by Environment & Climate which sits within Strategic Policy, Planning and Performance.
Strategic Policy, Planning and Performance (SPPP) is registered as a 'Controller' under the Data Protection (Jersey) Law 2018 (the "Data Protection Law"), as we determine the purpose and means of the processing of the personal information collected about you for this service. Customer and Local Services (CLS) act as joint 'Controllers' under this scheme for the purposes of providing data on those in receipt of benefits to allow them to apply for additional funding under this scheme.
As a Government Departments, we generally process and hold your information in order to provide public services and meet our statutory obligations. This notice explains in more detail how we use and share your information in order to provide the service described above.

We will continually review and update this privacy notice to reflect changes in our services and feedback from service users, as well as to comply with changes in the law.
How we collect information about you
Information will, in most cases, be collected directly from three sources:
1. Jersey Electricity Plc, acting as the Low Carbon Heating Incentive Scheme Administrator and a data processor
Contractors will submit low carbon heating incentive applications on a property owner's behalf, which will be processed by Jersey Electricity Plc.
This may be done in any of the following ways:
- by a contractor submitting an online application for a low carbon heating incentive grant application on behalf of a property owner
- by interested parties submitting feedback via an online survey
- by telephoning, mailing or emailing directly
Data from Jersey Electricity Plc will be shared with SPPP in order to process applications and their payments.
2. MCS Service Company (MCSSCo) as operator of the Contractor Quality Scheme
Contractors will register with MCSSCo to become approved as an installer of low carbon heating systems within the scheme through submission of an application form.
Data on the contractors may be collected via the following ways:
- by a contractor submitting an application to join the Contractor Quality Scheme
- by interested parties submitting feedback / complaints on contractors and / or installations to MCSSCo as the Contractor Quality Scheme operator by telephoning, mailing or emailing directly
Data from MCSSCo will be shared with SPPP in order to confirm the appropriate quality standards are met by the contractor / for the installation in receipt of grant funding.
3. Contractors that are members of the Contractor Quality Scheme.
Contractors that join the Contractor Quality Scheme will collect data from property owners in order to make applications for grant funding on their behalf and for quality assurance purposes.
Data on the property owners may be collected via the following ways:
- Information provided from the property owner to the contractor
Data from the contractor will be shared with Jersey Electricity Plc (and on to SPPP) in order to process grants applications and payments.
Data from the contractor will also be shared with MCSSCo exclusively for the purpose of assessment and quality assurance of CQS approved installations.
Other Government of Jersey departments and third parties
In some cases, we may collect information about you from another Government of Jersey department which we interact to deliver our duties:
- Property and installation information may be shared with Infrastructure and Environment, Building Control Department in order to confirm building control notification has been made as required
- Customer and Local Services will confirm whether property owners applying for low income funding are eligible directly with Jersey Electricity as Scheme Administrator
Types of information we collect
The types of personal data collected will vary depending on what information you volunteer and the information we need in each circumstance. However, we have listed below the most common categories of information we may collect about you:
- applicant details: including title, name, date of birth, address, email address, contact number and answers to generalised questions regarding your property and associated heating applications / insulation. Additional information is required where applications have been made for increased low income grant funding. In these instances, self-declarations of assets or letters confirming receipt of benefits are required
- installation details: including installers name, applicant unique grant code, date of installation, technical information regarding installation, additional information regarding Energy Performance Certificates and associated insulation recommendations or requirements
- quality assurance and customer survey feedback: including name of applicant or business, insight into any behavioural change following installation of low carbon heating system, generalised process experience questions, complaints and compliments about the service provided
How we will use the information about you
We need to collect and hold information about you, in order to carry out the public functions of the Environment and Climate team. Our legal basis for processing personal data in most cases is that it is necessary for the exercise of Environment and Climate function of the Government of Jersey or any public authority (Schedule 2 para 4(c) of the Data Protection Law).
We have set out in further detail below why we use your personal data in each instance.
Property owner details | To contact you if necessary, regarding your low carbon heating incentive applications application. To ensure grants are awarded to Jersey residents, and that no more than one grant is awarded per property. Where an individual owns multiple properties there will be a maximum permitted number of grants per individual, which will be no more than 5. Who we may share your Personal Information with
Other Data Controllers
We may disclose information to other public authorities where it is necessary, either to comply with a legal obligation, or where required under other legislation. Examples of this include, but are not limited to, where the disclosure is necessary for the purposes of the prevention and/or detection of crime; for national security purposes; for the purposes of meeting statutory obligations; or to prevent risk of harm to an individual, etc.
In some instances, this data sharing may require us to transfer your personal data outside Jersey and the EEA, however, we shall only do this with the necessary safeguards in place and where it is lawful because it is necessary and proportionate for the proper discharge of our statutory functions.
Service Providers
Your personal data may be processed on our behalf by certain third parties who provide service to us, so that they can provide those services. We have strict contracts in place with these service providers to ensure they process your data only on our instructions and with appropriate security in place. The categories of third parties who may receive your personal data to provide us with a service are:
- Locally registered contractors within the Contractor Quality Scheme
- Jersey Electricity Plc, acting as the Low Carbon Heating Incentive Scheme Administrator
- MCS Service Company (MCSSCo) as operator of the Contractor Quality Scheme
- Online Survey providers such as Smart Survey
At no time will your information be passed to organisations for marketing or sales purposes or for any commercial use without your prior express consent.
How long we store the information about you
We will keep your information accurate and up to date and not keep it for longer than is necessary in order to administer the low carbon heating grant scheme. Please ask to see our retention schedule for more detail about how long we retain your information.
Contractors are required to delete any sensitive data related to income status as soon as the installation is complete.
Government of Jersey, as the Data Controller, reserve the right to act as Scheme Administrator in the future and access necessary information to carry out this role successfully.
Where we store the information about you
Government of Jersey systems store data in Jersey, the UK and the European Union. The UK has been granted adequacy status by the European Commission and personal data stored there will be protected to the same standards as personal data held in Jersey and the EU. Jersey Electricity and Approved Contractors are based in Jersey and CQS scheme is run by MSCCo and based in UK.

Statutory or contractual obligations to provide personal data
You are not obliged by any law or contract to provide us with your personal data. However, if you choose not to provide certain information when requested, we may not be able to perform the service you have requested, or we may be prevented from complying with our legal obligation.

10. Withdrawal of Consent
Where we rely on your consent to process personal data (see section 3 above), you can withdraw your consent by contacting climateemergency@gov.je. If you withdraw consent for your information to be processing, you may no longer be able to access the incentive funding.

If you believe that Strategic Policy, Planning and Performance has contravened the Data Protection Law and the contravention affects your data protection rights, you have the right to make a complaint at any time to the Jersey Office of the Information Commissioner (JOIC), (https://jerseyoic.org/).
